I hope the CMA realise they have a can of worms in their hands and their investigation into Euro is the equivalent of opening the can only a millimetre.

You are right. If the CMA focused on a few companies, those we see on here such as Smart, Parkingeye, UKPC, Excel and Horizon, the others might wake up and comply with the CMA RULES.

Pity the complicity of the DVLA in the known scams cannot be investigated also.

A 90p ticket was purchased but the machine failed to record the registration number. This time someone stood up to CEL and eventually won £289.50 from them in court

If supermarket car parks also have EV chargers, parcel lockers or ATMs, then surely anyone using these facilities when the supermarket is closed are still customers, but of the EV charger, parcel locker or ATM provider? Presumably their installation was arranged by the owner of the car park.

The presenters seem to report this with some degree of levity. All good … unless you’re having to deal with a £100 charge for accessing a facility whose ‘rules’ seem to make no sense! They haven’t (yet) had a PCN snorter up their noses to deal with. They won’t chuckle so much then!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Customers put off going to NRG GYM Bedford after being slapped with £100 charges despite entering their car registration details on Smart Parking's keypad.
One gym customer reportedly received 19 'FINES'. Many patrons have taken to social media to complain.
Smart Parking claimed a 19-year-old hadn’t entered her car reg details on two occasions which she vehemently denies. SP cancelled both her charges on appeal, strange when they claimed it was her fault not a fault with their system. Maybe it was because her mother contacted the newspaper – and, that also doesn’t explain why other patrons have received 'fines'.
“Son and wife both had the same. Both adamant they logged in. Appealed and both reduced to £20. Manager is aware and no idea why it's not registering when putting in reg number.”
Well if the Manager doesn't quickly find out why Smart Parking’s registration system is failing he'll soon start to see gym membership numbers fall.

He may also find out cancelling that 'smart' contract, which is already killing his business, may be very expensive and lead to even more personal financial distress.
