    I suggest you respond saying that, yes, the driver was insured at the material time and proof of this will be provided to the court and the claimant as an exhibit at the witness statement stage of a court case should it progress this far.

    What did the SRA say when you complained to them about the solicitors actions?

    Did the driver have insurance s/he is compulsorily required to have?

    Who are they, the police or something? Lol. 

  • @Coupon-mad to summarise the thread until now. I have previously informed them of the driver who lives overseas. They lied to me about a failed attempt to transfer liability. Now they have asked the driver if they were insured. At this point, they have had the drivers details for several months, but have refused to transfer liability.

    Now that I have moved overseas and sent them a request to erase my previous address, it seems like they have changed their tune and have asked the driver if they have the insurance policy document.
  • Ironically, even though I am the registered keeper of the vehicle, I do not have a drivers license, nor have I ever been insured on my vehicle!

    I'd tell them that (the above) and just say "yes of course the driver was insured to drive the car.  Cut the crap; stop trying to act like the Spanish Inquisition, and damn well transfer liability to the named driver as the POFA requires."

    Or get the driver to reply thusly.

  • The driver has told Parking&Property Management that they have the insurance document. PPM have requested a copy multiple times but have not stated why apart from saying that it will help the driver. They have now gone silent and I suspect that they are beginning proceedings at my old address that I have requested they erase. They have also not replied to my request to erase my old address.

    I likely won't get access to any documents they send to my old address, but I'd like to avoid a default claim. Is there a recommended way to deal with this?
  • Did you send a rectification notice to the DPO of the PPC as well as their solicitors as suggested by Fruitcake a few weeks ago?

    Normally PPCs don’t talk to their customers once they have engaged a solicitor. If you find solicitors are still sending letters to a former address complain to the SRA
  • Yes, I sent it to both as suggested. I just spoke to the solicitors who said that the PPC have cancelled the charge. The PPC however, say that I should speak to the solicitors. I've asked the solicitors to send me a confirmation via email so I can follow up with the PPC.

    I'm pretty sure the document forgery by the PPC is what triggered it. Before I highlighted that, they were very uncooperative and reluctant to speak.
  • No-one here would recommend talking to a PPC or their scam solicitors as there is no documentary proof of a conversation - but it sounds like a win is on the cards.

    Once you have written confirmation complain to the PPCs ATA and ask them to investigate the fraudulent evidence. Perhaps you should also complain to your MP.

    You will have an opportunity in the next few months to comment on the upcoming government consultation on the new Code of Practice. I am sure you will have some thoughts about how you have been treated.
