Do you know what the definition of "known" is here, or if there is any precedence about it? I have read on some forum posts that they can claim that it is not "known" if the driver does not contact them. I can ask Person B to send another email, with a copy of the NTK attached. P&PM have just replied saying that I must liase with BW Legal and that the property manager has no jurisdiction over vehicles enforced and that under no circumstances should they act as mediators in any cases concerning the enforcement of any vehicles.0 -
Crack on and get some evidence of refusal to transfer liability then.
If that P&PM reply is by email, then seize this chance.
Start by telling them once again who the driver was and their address, and citing the POFA (basically throw some of the wording I gave you at P&PM now by email) and ask them to explain WHY they are refusing your legal right to transfer liability and on what basis they are continuing to process and share your DVLA data.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

- Stating that they have been informed of this multiple times before
- Stating that Person B has contacted them to acknowledge this
- Quoting the POFA about not knowing the drivers details and how this doesn't apply
- Explaining what begin proceedings means and shared the link
- Stating that it is causing distress, anger and frustration
- And that I will file the counter claims and reports as you mentioned earlier
