she has legal ownership of the property, i think ive stated this numerous times, i signed it over 8 years ago, she has the deeds
in the eyes of the council and the bank she has sole legal ownership of said property
Yes so you keep saying but your name is still on the mortgage so it still belongs to you.

You might mind when it flags up if they suspend your benefits pending investigation.
You've been given UC-specific advice - that it's for a Decision Maker to decide - and been told how to declare it.
As a reminder, here's what that was:NedS said:Unfortunately you cannot declare property that way. Drop a note in your journal (under payments) explaining the situation and your Case Manager will collect the relevant information from you and pass it on to a decision maker who will decide whether it can be disregarded.

I don't think that is what you have said earlier. You said you signed over your rights but you haven't said anything about who is named on the deeds.she has legal ownership of the property, i think ive stated this numerous times, i signed it over 8 years ago, she has the deedsInformation I post is for England unless otherwise stated. Some rules may be different in other parts of UK.2 -

You said here your name is on the mortgage...my name is on the mortgage, she couldnt buy me out, her solution to this was the legal document that stated i have no interest in the finances of the property (sorry im sure i stated this in the previous posts)

You can check here:Is there a mortgage on the property? If so, whose name is on the mortgage?DWP use data matching from the Land Registry data to identify claimants who own a property they are not living in. If your name appears on the Land Registry and you have not declared that property, a red flag will get raised and it will trigger a fraud investigation. Probably well worth the £3 fee to obtain the title register for the property from the Land Registry to make sure your name was officially removed from the deeds.BTW, you say she has the deeds - paper deeds are now essentially valueless (other than for historical value) as all records are stored online and have been for the last 20+ years.

but thats not what im asking
ive signed a legal document that transferred ownership of the property to her, that document stops me from benefitting in that property at the same time it stops me from having credit in it, thats what that document does, it was drafted by a lawyer and has been accepted by multiple organisations
i have no issue this coming up im not trying to hide anything or like a few people have stated commit fraud, i dont benefit from this arrangement, at the time i filled out the application and now i believe i dont own that property
this is really stressing me out and from the tone of some peoples replys im being accused of being a criminal
even if i claimed to own the property i cant enter a value of my capital because its 0, i cant enter the amount because i cant claim it, its not like if my benefits are stopped i cant go and sell the property, i also cant go back to work, the potential fall out of getting this wrong is massive
what do i report in the journal? im assuming that if they investigate they will request a home report etc i have no access to they things, i have no access to the flat
i dont want to hide it or anything i want it sorted constantly telling me to report it isnt advice
report what? say what?
i cant claim to own it or have capital in it, legally i cant!
my ex has no obligation to sort this, if UC stop my benefits i cant request any of the income or that she sells the flat

If you don't declare the situation with the property and allow them to make a decision based on the evidence then you face worse than a little criticism here, if they find out they will suspend all your payments until they've investigated and satisfied themselves of the situation, you'll likely get at civil penalty for not declaring it.
You're obviously questioning it yourself or you wouldn't have posted about it. Declare the situation in your journal and take it from there, you've had some really good advice and chosen to ignore it all.
Having sympathy with the situation your family finds itself in really isn't a factor in this."You've been reading SOS when it's just your clock reading 5:05 "2 -
ok im going to get a copy of the document ive signed and find out exactly where my name appears and report it all in my journal
i appreciate every ones advice and im sorry if ive not come across well, it wasnt my intentions2 -
Having read through I have no idea re a decision maker but legally you are a joint owner, no idea how you own (tenants in common and if so what shares or joint tenants) but the point you need to make is that you have no beneficial interest in the property. On a side note with property no "legal" document is valid unless it's registered, I doubt that whatever you have entered into is registered. If she is letting the property her income is irrelevant - you could do with pushing for the property to be transferred into her sole name and to be released from the mortgage. Whilst I appreciate that isn't maybe priority at the moment it is already causing issues.0
