Confused by parking fine from Parkingeye


My local Home Bargains has recently been closed for 5 mth due to a big refurb taking over the premises next door, previous to that as far as I know there were no parking restrictions there, so I went shopping last week parked up as usual. 

Today I got a parking charge from Parkingeye £100 or £60 if paid within 14 days, I have attached the parking charge  information and am confused as the the part where it says 0 hours 0 minutes max stay,  it seems on some Home Bargain car parks there is a max stay of 1 hour 30 mins but I was only there for 51 minutes and what is the 0 hours 0 minutes max stay about.

Any help is much appreciated thank you.

    That probably means that your vehicle was parked outside the permitted hours.

    Where exactly did this parking event take place?

    It was at the Hereford shop 26 Holmer Rd

    Was the shop open?

    Show us what the signs look like (please go and take photos).

    Does the PCN have the keeper liability wording about the POFA 2012 on the back?

    No the shop was close we arrived at 7.41am the shop opened at 8am

    Yes it does have the keeper liability wording about the POFA 2012 on the back

    I will go and get a photo

    Yep, it is important to see not just the signs INSIDE the car park, but also what the approach and entrance looks like, given you say this was never previously parking restricted/enforced.

    We need to see the entrance too, please.

    Also get any pics that show the building work or trolley bays are stopping view of signs by making it impossible to approach and read them.  That's all good for POPLA.

    This Google Street View image, taken in November 2020, shows no entrance signs about parking and looking around the car park on GSV, no other signs about parking either.

    This totem sign at the site shows BNP Parabas Real Estate manage the site...


    Edited to add...
    And this GSV image from December 2021 shows there were still no entrance signs about parking over a year later.
    So, controlled (I use that term loosely) parking was introduced less than six months ago.

    Site is next door then, no PPC in place in 2020 no update on GSV since:

    This charge is probably for entering the site outside of opening hours, absolutely ridiculous if so.
    A strong complaint to HB must be made from a customer's stance.
    I can understand them not wanting oiks in tuned up Corsas doing doughnuts in the car park at 1AM but a keen customer waiting for the store to open is harassment, and not a good way to treat people spending money.
    In any case enforcing these T&C's on a car park 7 days after a re-vamped store opened probably with Parking Eye on site for the first time is harsh and profiteering probably coming under BPA COP 19.10:

    Where there is a change in the terms and conditions that
    materially affects the motorist then you must make these

    terms and conditions clear on your signage. Where such

    changes impose liability where none previously existed then

    you must consider a transition to allow regular visitors to the

    site to adjust and familiarise themselves with the changes.

    Best practice would be the installation of additional/

    temporary signage at the entrance and throughout the site

    making it clear that new terms and conditions apply. This will

    ensure such that regular visitors who may be familiar with

    the previous terms become aware of the new ones
