Such instances will be viewed as a serious and sanctionable instance of noncompliance and may go to the Professional Conduct Panel3

I am not legally trained, but I would suggest that an open gate in a shopping area constituted "an invitation to treat".I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks1

It will be interesting to see what the entrance signs, (if any), say, perhaps something "stupid" like:-
"see signs in car park for terms and conditions".3 -
"Surely not; given what the BPA's Code of Practice states at 9.5:-"I am sure the DVLA are all over this as I have an email from them just a few days ago which states:-"SafeguardsAt DVLA we have tough safeguards in place to protect the privacy of information held on our records. One of those safeguards is that all unregulated organisations, such as private car parking management companies, requesting information from us must be a member of a DVLA Accredited Trade Association (ATA).All ATAs must have an enforceable code of practice governing the conduct and operations of their members. The code of practice has to be published on the ATA’s website along with contact details for enquiries and complaints. The ATAs for the private parking industry are;The British Parking Association (BPA) www.britishparking.co.ukThe Independent Parking Committee (IPC) theipc.info"Oh, wait a moment, it does not state that the members have to abide by the cop before the DVLA drop innocent motorists in the predatory ppc cesspit. Good on yer DVLA - really tough safeguards.5
