Rights with faulty used car

Hi,

Have a car that was bought second hand recently that has now had a very expensive fault. It is under 6 months old, so I believe I should be covered under the Consumer Credit Act to a repair or replacement.

The dealer was quite far away and I have no way of transporting it there, the dealer has tried to charge me £500 to get it back and has said they will only cover half the repair bill.

I know that’s not right for the repair and they have to repair it, but what about transport? Does anyone know if I am liable for the cost to get it back there now that it is undriveable

    Can you clarify?
    Is the second hand car under 6 months old?
    Or is it simply less than 6 months since you purchased the car?

    No, it was viewed through Zuto and then bought directly with the dealer and they shipped it to me. Never saw it in person.

    It’s under 6 months since I bought it, January. The car itself isn’t under 6 months old, it’s 2014 reg.

    Delivered in January, first arose around 10 days ago. RAC said they think head gasket has gone but I have put it into Ford for diagnosis.

    2014 Ford Focus ST.

    Around 11k for the car, bought from an online dealer who I paid to have it delivered

    I was going by the below on the 6 months thing, but could be wrong - 

    Which? Legal says: If your car develops a fault within the first 6 months of taking possession of it, the Consumer Rights Act 2015 states any such fault is presumed to have been there at the time of sale and should (hopefully) avoid the need to get independent expert evidence.

    Under 6 months it is assumed the fault was present at the point of sale unless the dealership can evidence it was not.

    What has caused the HG to fail if that is even the problem. Example a stone hits the radiator causing the coolant to leak out, the engine then over heats and destroys the HG. This would not be the dealer or credit providers responsibility and would be a normal risk of car ownership. 

    You would need to give the dealer a chance to inspect the car to determine the nature and cause of the fault. 

    The fault taking nearly 6 months to develop does strongly suggest it is not an underlying problem. That said if it is a 1 litre ecoboost has it had its recall work for the coolant degas line replacement done.

    The OP said it is a Focus ST, so that means a 2 litre Ecoboost, about 250 bhp.  Do they have the same recall issues?

    What is to be expected on a car of that type is that there is a high probability that it was driven aggressively by previous owner.
