Neighbour saying my garage is in his Garden
Comments
-
Unfortunatly it does show my garage going into their garden. It goes over my outline into theirs.theoretica said:What does this show for outlines of your garden/garage and neighbour's property?0 -
The official title plan would show a red line around the outline of your property/land and, similarly, your next door neighbour would have a red line around his property/land. It may not show a garage on the plan, but you should be able to work out whether your garage is situated within the red line marking your land or not. If you look at your title plan and draw the position of the garage on it, would it be fully enclosed within your land?
Could you post a redacted copy of your title plan and possibly mark the position of the garage on it, so we can understand a little better?1 -
Worth checking the whole boundary against the plan - is there a compensatory zig zag where land which should be yours is in your neighbour's garden?

The top image is from my documents and the second from the seller. I've put a little black line where the garage is situated.

So you agree that your garage is encroaching into the neighbours garden?

Is there an access road behind the properties?0

From those images, yes. It's not something I became aware of until today, though legally I guess that doesnt help me.NameUnavailable said:So you agree that your garage is encroaching into the neighbours garden?
I was just wondering because my garage falls into an exit/entry point to my property, do I have any kind of legal right? Because if my neighbour were to build an outer house of some sorts there (even if it is his land), he would be blocking an exit point. If you look at the image, plans to do it on a ally way/road that leads to a main rd, if that makes sense.0 -
Yes, it's like a drive through road that's quite muddy, that you sometimes see behind houses that leads to a main rd. It's so if I wanted to park my car in the garage, I can.Thrugelmir said:Is there an access road behind the properties?0 -
Hmm, it certainly looks like a past owner of your property took advantage of that right of way a bit far - maybe with the agreement of a past owner of the neighbour's property, maybe not. But you will also probably want to look out for your neighbour trying to take advantage in turn and make sure that right of way stays clear for you.

They can't block any legal right of way.
