Unfair Dismissal medical reasons

    They have appealed the dismissal and still waiting for teply

    This is the latest communication with their old employer

    I do hope my appeal is successful as I really feel it was unfair dismissal on medical grounds even though it was claimed it wasn’t.

    I never had any of these anxiety problems for years in old position it was only from the new assignment which I said I was not suited for. I understand it can take a bit of time to ask for a change but my situation was so serious it was not right to keep me in that position for so long after I notified how serious my panic attacks were.

    It would be very unfair to dismiss me for those reasons and I have been in touch with a legal firm who have looked at my case and looked at my evidence and they have offered me no win no fee if I am dismissed.

    Any court will agree it was for medical reasons brought on by being pushed too far for too long after I informed I was getting panic attacks by carry on driving into that patch for too long after I had officially informed my manager that it was causing me panic attacks.

    If I don’t get dismissed then it won’t have to go to court


    Keep in mind that they / you have three months, less one day, from the date of dismissal in which to file an employment tribunal claim. Extensions to this time limit are very rarely granted unless there are truly exceptional circumstances.

    As others have intimated, the draft letter they / you have written is, quite frankly, appalling. However as they / you apparently have legal advice so I am not sure why you are asking for advice from a bunch of strangers on here, who may or may not be experienced or qualified.

    Well we know the objective and we know the calibre of the advice the op is taking.

    This isn't going anywhere is it 

    Thread should really wind down because as the OP has now been proven to be inconsistent with facts offering any kind of advice given it could end up legal is irresponsible as it's likely based on incorrect info

    The wording gives away that you most certainly haven't 'been in touch with a legal firm', let alone received the advice you claim to have received. Maybe you should get in touch with a legal firm to see what they really say about it?
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    I agree.
    Having employed staff, if I were to receive a letter like that, claiming to have taken legal advice which is clearly false and threatening court action, then I would take any idea of a "go away" payment off the table and have a word with a solicitor about whether any proceedings could be regarded as vexatious.
    The former employee wouldn't be getting their job back nor any payment at all from me, but if I could cost them some money then I would have no qualms whatsoever about doing so.

  • These days mental health awareness is talked about a lot 

    these kind of things are not to be taken lightly 
  • Legal firms love these kind of cases especially when there is a lot of evidence 

    big firm useually prefer to settle out of court if it would cost more to go to court

    when someone has nothing they have nothing to lose😁
