I read a while back on another forum that someone replied back to the email and they had the case cancelled.

When I say court letter, I mean the correspondence which has the date to go to court to defend my case etc…..currently away so not sure on the title.
If you have a Notice of Allocation it is pointless playing letter ping pong with solicitors.

Have you read the following thread, I'm sure you'll find something quite reassuring in it?  You must continue working to the requirements placed on you by the court in order to push Highview/DCB Legal closer towards the discontinuation precipice.
    Hi All,
Having returned from my holiday, I have read this thread so thanks for this. It looks to me as though DCBLegal seem to discontinue the case close to the court date. I do have a "Notice of Trial Date" Letter which has given me a trial date of 23rd November. It states that the claimant must pay the court fee or file a properly completed application for help with fees etc. they have a date of the 26th October to do this otherwise the claim will be struck out.

At present, I have not completed a witness statement and I have until the 26th of October to produce my evidence that I rely on to the parties involved. Having said this, is there any point in wasting my time if the case usually gets discontinued (I am due to go on another holiday later this week until next week).

I have received the below (to which I did not respond) -
    • Email to defendant from DCB Legal with 'Without Prejudice Offer to Settle'
I have not yet had a phone call from them and it looks like the next step is the email - " Notice of discontinuation" from DCBLegal, does this usually come before I have to submit any witness statement, or can it be after this date, and I have to complete my witness statement.

    Thanks again

Get out of your head they will discontinue
Treat this as if its going to a hearing.

Currently typing out my witness statement, I've read through the newbies thread and the example of a witness statement given on there. Can anyone point me in the direction of a good example of a witness statement defending the claim as a keeper rather than a driver. Thanks in advance

Forget the one in the NEWBIES thread.  Old case law there, now superseded in 2022 by the sort of WS shown in the thread by @aphex007

Reading your defence you are going down the PoFA line, there are many WS (via the search facility) but I think the one that is highly recommended is @aphex007
I have PoFA statements in mine as well so you are welcome to view that - think you should find it within my user profile.

    Woohoo!

ANOTHER DCBLEGAL DISCONTINUANCE BITES THE DUST!

And we sincerely hope that you are au fait with the need to respond to the final Government Public Consultation?

Hopefully - amongst all the political disruption - it will be open later this year.

We all need to ram the nail in the coffin of the false £70 'DRA fee' add-on, that actually funds the court claim and toxic CCJ culture, as well as the DRA gaslighting of people.

If PPCs manage to turn around the decision on banning the gaslighting / claim-funding 'fees' then the DLUHC will be rubber-stamping £200 parking charges and if that happens, they (Government) and the PPCs will wreck high streets and people's lives.  Whoever is responsible, if that happens (and it very nearly did in 2021) must hang their heads in shame.

Just checking you are among those ready to respond to the questions as you have repeated personal experience of how this crap feels?  Please come back here when it opens, and you can make sure you don't miss the Consultation:

If you are not a regular reader, to be alerted you'll need to bookmark the thread by MSE_JC at the top of the forum and enable (on your profile) email alerts for bookmarked threads.

Then join us when the Consultation opens.

Sorry if you knew all this already - I had no time to check back through the thread.

Here we go again, number 62. I see that @patient_dream (thanks 👏) has already linked this in the DCB Legal Hall of Shame Announcement.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
