If you are relying on "no keeper liability" just be careful not to intimate who was driving during any of your defence paragraphs. For example in one of your posts about appealing you put "I was putting a gap in......." which could be taken as from the driver. Not sure that you can claim "on an unremarkable day" given that you were buying a sofa and had to return the next day!1
