Help needed liability admitted for a Highview invoice - ccbc

Hi,

I have a ccbc for a parking invoice from June 2016, I was 21 minutes over the 2 hours allowed.

I have emailed Highview for a SAR.
They have replied with information. It turns out I did try to appeal the the invoice in September 2016 via email but it was 3 months too late. Highview replied to my email stating it was with the debt collector.

In my email to appealpcn.co.uk in 2016 I said I was purchasing a large item for my home and ran out of time, the shop was closing and we had to come back the next day to complete the purchase, which I did. I sent over the purchase receipt to Highview.

I need to know if I can fight this charge of £302.88? Even though I've admitted I was driving

    Hello and welcome.

You appear to be saying that you have received a Court Claim from the County Court Business Centre in Northampton. Is that right?

If so, please tell us the Issue Date on that Claim Form.

Admitting to driving is OK.  That's not admitting liability.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

When you say you have a CCBC, please be more precise. Do you mean you have received a claim form from the CCBC, which would mean you should have received a LBC/LoC a month ago?

Yes you can defend it, and even if you lost you would end up paying less than the PPC is currently claiming.
Start by reading the guide to court you will find in the second post of the sticky Announcement for NEWBIES.

What happened when you complained to the landowner and store manager/CEO?

Have you complained to you MP yet?

I haven't complained to MP. The store manager told me to appeal. I didn't return to say the appeal had been rejected.

Issue date of ccbc is 16/3/22
But the CCBC is the County Court Business Centre.

I have done an AOS on 25/3

With a Claim Issue Date of 16th March, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 19th April 2022 to file your Defence.

That's just a week away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

Sorry I've misunderstood issue date. Would that be the date of pcn. That would be 21/5/2016

Thank you for pointing out I should not send a defence to the MCOL website.
