Yes, a ROW doesn't vanish through lack of use or purpose.theoretica said:
I read up on that once and even if the right of way is for something that no longer exists (eg access to a well, or here a garage door) they still legally have ROW to where it was - unless they agree to change the deeds.

Just made a quick sketch at work. Hope this makes things a bit more clearly. The brown bit is the right of way. The parking takes up 95% of the space and I have to squeeze to fit through. If I want to fit anything through there to take into/from back of garden or garage it's impossible.0 -

Yes, we own the area in brown. His title only states that he has a right of way as I stated in a previous comment.The other cofreeholder told me he had wanted to buy the freehold in the past but she refused it.
edit: my solicitor confirmed we own the land in brown in a previous email1 -
