Boiler juice

I ordered oil (750 litres) on 23rd February after receiving a prompt email from boiler juice saying prices set to rise and I was starting to get low - I got a price of 64.15 per litre and paid £509 to secure my order which was due for delivery by 9th March 2022 - boiler juice phoned my husband on the 9th and said as oil prices had increased so much they were unable to deliver at the price we paid and gave him 2 choices either cancel the order and pay £1,50 a litre or pay them then and there £200 over the phone - we were almost empty by this point and my husband felt pressured to agree to pay the extra but needed to check as it was my card on the account boiler juice said it was his card and that they would take the money and we would receive the oil the next day - when checking my various accounts they had taken £282 from my credit card without my permission I tried to call them the whole day to find out why they have not honoured the price I had ordered at and there phone lines no longer pick up - I emailed and tried to do the chat which again cuts you off . I
contavted the oil supplier new ere fuels who said it was boiler juice I needed to speak to and it’s Correct that they have decided to cancel all previous orders as they simply couldn’t afford to sell it at the price it was 2 weeks ago ! The oil has arrived today but I still feel this is not correct I wouldn’t expect them to refund me if oil plummeted and I’m sure they would say the price on the day is the price you pay , oil prices change daily and I’ve used boiler juice many times and have never been asked to pay more or less than the quote / price I agreed to any help greatly received

    I had a similar issue with a BJ order placed in early Feb.  They tried to tell me that they just owed me the money I had paid i.e. a refund. 

    I stuck to my guns and told them they owed me 800 litres of oil as a legal contact was in place in that they had offered a price; I had accepted their offer and paid in full at the time of the order. The bargain was complete at that point, and so they owed me 800l of oil and not cash. 

    The oil was delivered 48 hours later :smile:

    Your contract is with BJ, not the actual oil supplier, so it's BJ you have a dispute with.  What do the terms and conditions say about when the contract is formed and when the price is determined?  At the point of payment, or upon delivery?  Were you actually charged the £509 in February, or was payment due when the oil was to be delivered?  Do the terms mean that you agreed to £509 worth of oil at the delivery price, rather than ~800 litres at 64.15p per litre?

    Unfortunately by agreeing and paying the difference you changed the contract.

    If you refused the changes then you had a case of buying elswhere if they still refused and sueing for "loss of bargain" which would be the difference in price between what you contracted for and what the extra was.

    If the price more than doubled then why was it only £200 the took from your husband? It should have been much more hence the charge to you CC.

    You could try a charge back but as they have your details on record then it could be seen as authority to charge the card when there is a bill to pay.

    Even if the charge back is succesfull you will still be due to pay the £289 owed.

    Thanks, that answers the questions I posed, I think.  The problem for the OP is that as bris has pointed out, they've already agreed to a new contract, so the old one is void.  Had they done the same as you, it seems they would have been obliged to supply at the original price.

    They said that they were letting customer have the oil at a cheaper rate and we’re paying the difference so that it ment they were still getting it cheaper than the market value I have contact cc card to see if I can get a charge back on the funds taken

    I agreed to 750 litres at the price 64.15 not 509 I have confirmation of this agreement and have received nothing in writing with regards to any changes or further charges

    I doubt that will work because your husband agreed to the price and the oil has been delivered.

    So what were the terms and conditions of the order?  That's the important bit.
