Help needed - Paid for parking but at the wrong location.

    Plus the POFA if it's a non-POFA PCN (which the NEWBIES thread already explains how to spot).
    Thank you, I am guessing that when submitting the Appeal I also need to use the third party reference to the driver?

    In parallel to the IAS appeal is it also worth me complaining to the Local MP for Staithes and trying to find out who the landowner is?

    Yes and yes, or admit to driving if it makes the appeal more of an honest account BUT only if the PCN is POFA compliant (see NEWBIES thread re the POFA).

    Will do - I never received a PCN as it was an ANPR car park so just the NTK but I will review and ensure compliance to POFA.

    I have now submitted my appeal to the IAS.

    I have also written to the local MP as well as my own MP. I have also found the details of the landowner so will be writing a letter to him as well.

    Will keep the forum posted.

    I now have a response from the Operator on the IAS portal. It it’s you would expect, they are refusing to cancel the charge. I have now further evidence to add but guessing the next step is to refer to the IAS adjudicator and awaiting the outcome?

    I have already submitted the receipt for online payment and referred to the new Code of Conduct and statements from the DLUHC. iPark Services have come back and pretty much ignored the fact I have paid but for a wrong location. They have supplied the PCN log from the machine itself and are referring back to the fact that I broke the Ts&Cs of the car park so am liable for the £100 charge.

    Is it worth stating anything around as this is a breach of contract at best £100 is grossly out of kilter given the parking charge for 2 hours is £3? Is it also worth stating I have written letters to the MP and landowner?

    No.  Neither will fly.

    Pick holes in their evidence instead.  Undated signage photos, maybe?  No evidence of where the car was in relation to an illegible sign?

  • Thanks, I will go back and review and see where there are holes. Unfortunately due to the controversy at this car park a few years ago a lot of the signs were updated so are far more prominent than they previously were.
  • Whilst reviewing the response to my initial appeal from I Park as the Operator I have noticed they have stated a ticket was issued on the date I was in the car park. However no such ticket was issued or attached to my windscreen - probably a technicality but surely it is worth arguing about this inconsistency in my response before it goes to the 'adjudicator'?
