Being taken to court for a paking over stay i was not the driver but do not know who was the debt has been passed to dcbl it is in july 2015 is this debt statue barred .I have not said it is my debt and have never paid anything on this debt .I have been told court case in April  2022 can anyone advise me apparently i should of sent the deffence in feb and missed the time is there anything i can do

Who is the claimant?

Is DCBL DCB Limited or DCB Legal?

If you have a court case pending then you must have received a LBC/LoC followed by a court claim.

In Scotland a debt is statute barred after 5 years and ceases to exist.

In England and Wales, a court claim cannot be started after 6 years, but the debt still exists.

Was a court claim started against you before 5 years, if you live in Scotland, or before 6 years if you live in England or Wales.

You must mean you have a hearing in April.  If they filed the claim before July 2021 it was just in time.

What does the hearing Order say about the deadline to get your witness statement in, and evidence?

Have you received theirs?

What did you put in your defence in 2021, word for word please?

sorry so many things going on with family. I have missed the date to put up my defence so nothing has been sent

I have proof i was not the driver because my employer has records of that date i was working and with who and has gave me a letter

I think you mean you missed the deadline to do a WS and evidence?

The answer is simple - do it NOW.  People file them late quite a lot, and it usually doesn't bother a Judge.

yes i have had theirs. this is the statement i gave them I dispute the parking charge , as keeper of the vehicle, I deny
any liability or contractual agreement, as i was not the driver on
the day.
I have been advised that it is not a requirement for me to name
who was driving, and no assumptions can be drawn.
The Claimant has not provided any details of the offence, other
than the vehicle was parked in breach of the terms on the
claimants sign.
After nearly six years all I can confirm is, that I was working on
this day and would therefore not be parked at Beacon Retail Park.
