You can't rely on the 28 days mentioned by the CCBC. Just because you known the CCBC has received your defence doesn't mean that they have sent it to the claimant yet. You don't know when the defence will be sent to the claimant, so you don't know if or when the 28 days clock has started ticking, therefore you don't know when the 28 days stipulated by the courts will be up.

Assume the case is going ahead.

28 days has elapsed. They mention that if the claimant doesn’t respond within 28 days the case gets stayed.
Do you know when the CCBC sent the defence to the claimant?  If you don't, you can't tell when the 28 days has elapsed.
Could anyone please explain what stayed means
    Google can.

Just wait for your N180 and ignore the usual template letter from the solicitor saying their client wants to go ahead.

  • Hi Guys

I have now received the  N180.
I will fill it in as advised by bargepole on the Newbie’s thread.
Do I send it back recorded delivery and send Claimant  a copy recorded delivery?

What does bargepole's guide to court tell you about returning the N180?

Can you not download one, fill it in, add a digital signature or print, sign, scan, and then return it to the same email address where you sent the defence? (Did you send a copy of the defence to the PPC as well? You should as some of them have a habit of saying they never received it.)

I believe recorded delivery no longer exists. It might be alright to send documents that require the recipient to sign for them to the CCBC, but you should never send anything needing a signature to the claimant. If they don't sign for it then they will have proof they never received it.

If you have to send anything by post, then send it first class from a Post Office counter and obtain the all important free proof of posting.

  • Thanks fruitcake

Correct me if I’m wrong but bargepole doesn’t mention how to return the N180 in the Newbie’s thread?

I have received this letter below I think that is evidence they have received a copy of the defence?

I will follow your advice and scan/email the N180 back to Northampton County court.

Your advice has been spot-on so far thanks very much for your help and everyone else’s.

You appear to have abandoned that checklist you were following when you filed a Defence.
It answers all your current questions.

For your convenience, here again are points 7, 8, 9, 10 and 11 from that list...

The above is from the Template Defence thread first post.  I wish more posters would revisit it after defence!
