Do you have it in writing that the gearbox was rebuilt ?, do you want to pay for an expert witness and take him to court and still risk losing ?

You don't have many private sale rights but the car should match the description, you still need to be willing to put your money up and take the risk of losing. Have you spoke to the seller ?
In the process of speaking to him now, just posted here to see where I stand really.

Transmission rebuilt but that may not have been the issue or it has now developed a new issue?

Unless any warranty was transferable then you will need to get it inspected fully.

The car has a well known fault with the gearbox, getting them rebuilt cures it.
If you know the car has a known fault with the gearbox then surely you'd want to see the paperwork for the rebuild to know that it has been done and when before actually buying? Without that it's just someone's word which as you've found is worthless. Or it's possible that it was done but so long ago that it's failed again. Very tricky situation once you've bought the car and haven't got any paperwork if it was an important issue.

Does it mention rebuild on the advert?
Remember the saying: if it looks too good to be true it almost certainly is.

People are caught up in an egotistic artificial rat race to display a false image to society. We want the biggest house, fanciest car, and we don't mind paying the sky high mortgage to put up that show.
