DCBLegal ltd Letter Of Claim

If you are within the timeframe set by the court to pay the judgment, then paying now will preserve you credit rating. If there are grounds for applying for a set aside, the set aside can be applied for straight afterwards (no delay). If you find there are no grounds for a set aside, the £275 fee would be wasted in a set aside application. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

They must have used an old address on the claim form. You need to know for sure, so ring the CCBC (Northsmpton) and ask what address for you was on that claim and can they send over a copy of the particulars of claim and who the claimant and solicitor was.
Worth checking this isn't a coincidence about another PCN. Hence the questions.
If a claim was sent to an old address when the claimant had the new one the I would NOT pay off the CCJ but would instead tell the claimant to put right this damaging data breach error and give them 14 days to admit they screwed up and that they will immediately inform the court and pay to set aside the CCJ sharpish.PRIVATE 'PCN'? the address on the court case (checkmyfile gives name, date, amount, and address) is my address from 3 years ago (when the pcn was issued). But all parties have my new addess.
I am not sure when i went on the electoral roll here- so maybe they sent to the intervening address. It may have only been a month or two ago.0 -
And they can't do that as they had your new address. Does it identify the parking firm as the same claimant?
My advice above stands. Check the facts from the CCBC then send the solicitors a truly snotty email along the lines of the one I wrote yesterday for the case where the thread title says 'CCJ but I'd paid the PCN' (can't recall who by).

Thanks c-mad
Can i ask for a little more on the data breach- error, so I can work out how to phrase it? The breach isbthat someone at the old address has got my letter?
I appreciate all this help, thanks. Will be calling around this morning0 -
The breach is nothing to do with the person at the old address getting your mail.
The DRA 2018 breach is that this PPC/their law firm failed to erase the old address and failed to take any reasonable steps to ensure the 'roboclaim' was served to the correct address. They had your correct address for service and used an old one instead. They caused the CCJ.
@Old_Slobberchops is dealing with a similar case where DCBLegal will also be reported to the ICO and SRA (both easy to do online - must be done ).
But always phone the CCBC first, to get the name of claimant parking shark, name of solicitor and the Particulars of Claim. You need to be sure and have evidence of what they did so ask the CCBC to email you those details.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok you need this case on a new thread. You aren't going to pay it! Set it aside obviously.
As I suspected...not the same case. You need to know for sure, so ring the CCBC (Northsmpton) and ask what address for you was on that claim and can they send over a copy of the particulars of claim and who the claimant and solicitor was.
