"The letter confirms the defence was received and that the claimant has 28 days to respond. If the C wishes to proceed he must contact the Court and subsequently the Court will inform the D."
Has the C informed the CCBC that they are continuing with the claim?2 -

Has the C informed the CCBC that they are continuing with the claim?I have no evidence that the C has informed CCBC of their intentions. The letter I have received from HMC&TS is very clear:"I acknowledge receipt of your defence. A copy is being served on the claimant (or the claimant's solicitor). The claimant may contact you direct to attempt to resolve any dispute. If the dispute cannot be resolved informally, the claimant will inform the court that he wishes to proceed. The court will then inform you of what will happen.Where he wishes to proceed, the claimant must contact the court within 28 days after receiving a copy of your defence. After that period has elapsed, the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay."It has been 12 days now since my defence was submitted and confirmed received on MCOL.My question is if I should wait for the Court to contact me (as instructed in the letter) or I should download the DQ (from the internet as I did not receive one with the HMC&TS letter) and submit it to the C as instructed in bargepole's post.

The CCBC have sent you a letter saying the Claimant had twenty eight days to consider your Defence. What you don't know is when the CCBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CCBC.Further, we don't know what delays there are in the CCBC that means they don't send you a DQ as promptly as you might like. Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course.3

Just a reminder. If the claimant sends you a DQ, do not use it. Only use one sent by the court or one you have downloaded yourself.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks3
