Spa Road, Southampton.

Hi All,
I've received a PCN from Premier Park, having waited, engine running, for approx 7 minutes, I wasn't even parked in a bay. I have complained to Poundland, as the ticket stated that's where I was 'parked'.  but Poundland say it's nothing to do with them, they don't employ them.

I have appealed using the "Registered Keeper" and not saying who was driving, as I've done before with success. But I have now received this reply :

We write to acknowledge receipt of your recent online appeal, on behalf of the driver, appealing against the issuing of a Parking Charge Notice (PCN) to the vehicle.

 We note your comments and must refer you to the Protection of Freedoms Act (PoFA) 2012, Schedule 4 - Recovery of unpaid Parking Charges. This is available to view online at:

We now therefore request that the details of the driver of the vehicle at the time of the contravention are supplied; this must include their full name and serviceable postal address.  If you are unwilling or unable to provide these details the registered keeper of this vehicle will remain liable for this PCN.  This information should be provided by 12th February 2022.  Please note, Premier Park Limited will not reply to any correspondence until after the above date, if the requested information is not provided.

 If we do not receive this information by the above date, the appeal will be formally responded to and we will hold you liable as the Registered Keeper of the vehicle on the date of the contravention.

 Please note if we receive correspondence from the driver at the time of the incident we will not respond to you further on this matter.

  • Do not reply, and certainly do not tell them who was driving.

    You should  read the  'Newbies' thread as everyone is asked to do. 

    Please read, read and better read lots, and I mean lots,  of other people's threads to get a better idea of how this game that you are now caught up in works.
    There may be others that have been caught at the same site as yours that may have information that could help you.


  • @go-on-then Thank you, but I have read the Newbie boards, they all suggest that the registered keeper can't be fined, but this letter appears that I can? I have also searched this forum, but can't find anyone else with a problem in Spa Road.
  • Have you complained to the landowner as you are advised to do in the Newbies, plan A ?   You must read and follow the steps.

    What PPCs say and the truth can be two different things. The letter you quote is certainly supposed to make you think that they can hold the Keeper liable, BUT you need to read the 'Newbies' and then check the wording on the PCN to see whether it is actually  PoFA complaint  or if it is just a bluff. Check timescales too
    The pen is mightier than the sword ..... and I have many pens.
  • Is this on a retail park ??   West Quay ?  Above Bar Street ?

    It helps to give exact location etc then others may be able to help more.

    I tried to complain to Poundland, Above Bar, as that was the name they put on their PCN, but they said it was nothing to do with them,

    Our Property Team have confirmed that the service area is not leased by Poundland although we do have a right to use it. 

    We do not issue the fines and have no involvement or relationship with the company that does. 

    I am sorry we are unable to assist you further with this matter.

    The area is in Spa Road, the rear of Poundland, Boots,
  • Poundland are not the actual landowners, you need to find out who they are and complain direct. 

    As Trainerman says, you need to check your pcn to see if it is compliant with POFA or not to see if they can hold the keeper liable or not, that is why you are told not to say who was driving.

    No it doesn't.

    They can, under the POFA, if the conditions in Schedule 4 were met.  Were they?

    What do you mean 'they all suggest'? There is only one NEWBIES thread.  It does not say what you are saying above.

  • Poundland haven't been very helpful, can't find out who owns land, I've checked Google/maps, the signage is pretty poor, the 'bays' are not clearly marked, as far as I can see on the photo of the car, not visible markings. The PCN say the reason for issue is No Valid Virtual Permit, ( whatever that means) the photos are poor quality.
    The PCN says they have the right to recover any unpaid parking charge then quoted Paragraph 9(2)(f) of schedule 4.
    It certainly looks like they can make me pay, even if I won't give the drivers name.....
