Uk Parking control / DBCL up to no good

last year this forum helped me win a set-aside case with costs against, capital car park control and DCBLegal.
At the time one of the key pieces of evidence on my side was a letter from DCBltd and UKPC closing the case and stating no further action to be taken for a ticket on a car that was written off in an accident weeks before they claim it was parked on their land. this was in December 2020.
Anyway, I've just discovered that DCBL legal and UPKC have issued a letter of claim for this closed case
The facts haven't changed, but they seem to be trying to get a payout anyway, surely they can't bring a claim, there's photos of the car crash, insurance evidence, a police crime reference as to the car being vandalised and the plates stolen, all of which UKPC have had since 2020
I have contacted them with an updated address for contact, but it is outside the 30 days given in the letter of claim, are they required to update me if they get a new address after issuing a court claim.

Email that letter to DCBLegal and ask them what their definition of 'will not be pursuing further' means because it doesn't match a reasonable man on the Clapham omnibus' interpretation.
Copy in the DPO of UKPC to this email.
Tell them both that it is obvious that UKPC have failed to erase the data of a closed case and this is in clear breach of the GDPR and DPA 2018.
As such, you are complaining to their clients, whose DPO is copied into this email, and expect ALL your data to be erased forthwith and a written apology, failing which a complaint about both UKPC and DCBLegal will be lodged with the information Commissioner.
Finally, tell them this is the final straw and should they now file a claim for this closed case, you will defend and file a counterclaim of not less than £500 for damages for distress caused by harassment and data misuse. And you will seek all your costs on the indemnity basis should they proceed with a clearly vexatious and unreasonable claim using data no-one could be bothered to handle lawfully and erase.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

A great headline and you are right. As coupon said ask them "their definition of 'will not be pursuing further' ... Judges are always inerested in these flaws and stupidity
And yes a counterclaim of £500 is wise. THIS KEEPS THE CLAIM ALIVE so they cannot discontinue and they have to face the judge. WHOOPS. Of course can always settle your conterclaim out of court

Honestly I've been working 70 hour weeks and had little time to deal with that any further, I find it all very difficult at the best of times, since the court case I've been left alone so have not persued it any further1
