Terry Szmidt ICO complaint letter and Cease and Disist

I am in the process of trying to raise my complaint to the ICO about my case and write cease and desist letter to terry szmidt, I have a basic outline of my ICO letter below, but struggling a bit to find the right things to say in regards to the cease and desist, essentially, he now knows I am disabled, his signs are not compliant with equality act 2010 and any further action against me is both harassment and direct disability discrimination for which I WILL be seeking damages if he proceeds any further.. I've read one example on here, but the circumstances are very different to mine. can anyone point me to further resources ?

Information rights concern

I am concerned that you have not handled my personal information properly. You obtained my information from the DVLA under the KADEO contract in February 2019, this information was specifically to be used for one purpose. It is not an asset which you own than can be freely traded and shared at your convenience. My information was passed to Capital car park control Ltd a new business which had no rights to my data. This was then used to bring a claim against me, and a CCJ was filed in my name, this case was struck out by the courts on 18/05/21 as no debt had ever been assigned and no data should have been transferred.

The misuse of my data has caused financial damages which can be evidenced and emotional stress, due to the litigation and my learning disabilities. Breaching the provisions of the Data Protection Act 1998 gives rise to liability in tort - Google Inc v Vidal-Hall & Ors [2015] EWCA Civ 311.

I understand that before reporting my concern to the Information Commissioner’s Office (ICO) I should give you the chance to deal with it.

If, when I receive your response, I would still like to report my concern to the ICO, I will give them a copy of it to consider.

You can find guidance on your obligations under information rights legislation on the ICO’s website (www.ico.org.uk) as well as information on their regulatory powers and the action they can take.

Please send a full response within one calendar month.

As well as the above, I suggest you omit the last two paragraphs. Give him a reasonable deadline, and stick to it. Don't give him any wriggle room to keep asking questions and drag it out.

IME, C&D letters should be vrief and to the point, there are pleny of examples on the internet.

Hi so I have learning disabilities and am especially bad in this area, I have software on my computer that auto correct obvious errors but it fails on things like this that are non standard that I would not be able to spot. Appreciate people pointing them out so I can correct, but it's just not something I am Particularly able to do on my own.

Agreed , that's why you have many eyes looking at it , to assist you to get it right in the final draft

Appreciate your no belittling me, I'm just saying I couldn't see some of the errors even when/if I looked for them,
