Submitted defence a few days ago, received a small claims track letter today - just checked MCOL:

Your acknowledgment of service was received on 18/01/2022 at 08:06:04

Your defence was received on 02/02/2022

DQ sent to you on 02/02/2022

Ok , so now follow the 12 numbered steps again , in the defence template post ( written by KeithP ) and download the N180 pdf , fill it in , email to ccbcaq email address plus Excel , check for CCBC email auto receipt again

That seems a bit premature; are we to believe that the CCBC have sent the defence to the claimant and the claimant has replied and said they wish to proceed all between 02/02/22 and now?
  • This is the letter I received, looks like the courts are trying to get us to deal with this between ourselves...

No, that is normal.  Just complete the DQ (N180) form as per their instructions and as per the numbered steps in the template defence thread: -
    6.  After filing your Defence, there is more to do.
    7.  Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire and the usual intimidating template letter saying they 'intend to proceed'. Nothing of interest there. Just file it.
    8.  Wait for your own Directions Questionnaire from the CCBC, or download one from the internet - https://www.gov.uk/government/publications/form-n180-directions-questionnaire-small-claims-track , and then complete it as described by bargepole in his 'what happens when' post linked from post #2 of the NEWBIES thread - https://forums.moneysavingexpert.com/discussion/comment/64350585#Comment_64350585
    9.  The completed DQ should be returned by email to the CCBC to the same address and in the same way as your Defence was filed earlier.
    10. Send a copy of your completed DQ to the Claimant (or their solicitor if they are using one).  Their postal address is on your Claim Form but you can find an email for them by searching this forum, or Google it, because a DQ sent by email is OK and then you know/can prove it's been sent.
Don't miss your deadline of 21 February.

They do seem to be wanting these N180 forms early , instead of the old process , seen a few on here recently , so comply with the order and email your DQ to the ccbcaq email address and the lawyers ( or claimant if no lawyers )
  • Really appreciate your help and walking me through the process, thank you :)
  • Had a really busy week - received this a few days ago. I'd like to offer to pay the amount I would have been charged if id seen the signs... is that a good way to respond?

I wouldn't even respond to that letter, but you do need to note that Elms Legal are no longer acting for Excel.
  • N180 submitted by email and also sent to claimants email address.
  • I would like to send this to the company - any thoughts?

    Dear Sir/Madam

I write in response to your letter dated 08/02/2022

I do not accept your offer of a reduced settlement charge of £185.

I agree in trying to resolve disputes where possible and so am willing to pay £1 which I would have paid on the day had I been aware that this was a paid parking area. If this is acceptable, please confirm bank details and any reference.

    Yours faithfully
