    If you really must respond with something like that then do include the words Without prejudice - save as to costs.

    This means that the Claimant cannot use your letter as some sort of admission of 'guilt'.

  • I've received an email on Friday from scmreferrals with an appointment date for mediation. I didn't respond previously as suggested above - should I say no to this? Thanks as always for your support and help... C :)

    Do not agree to mediation. You want your day in court.

    Mediation goes like this.

    Claimant: -   Pay us everything we have demanded.
    Mediator: -   I think you should pay everything the claimant has demanded.
    Defendant: - No

    End of mediation.
    I married my cousin. I had to...
    I don't have a sister. :D

    I think I am struggling with the threads / links within thread format and either lose what I want to post here or end up following a link and trying to read or understand a lot of information. 

    Just an FYI, the reason I included pictures is that I read further down the "2nd post in the newbies thread" which starts  

    IMPORTANT - KNOW WHAT YOU MUST DO AND BY WHEN!

    There is a link underneath a heading "A current good example of a Witness Statement:" and I adapted that. 

    I think I am confusing a defence statement with a witness statement...

    So now I think I must take out the pictures and remove references from the text and follow this process from KeithP:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or  <download one from the internet> and then re-read post #2 of <The NEWBIES FAQ Sticky thread> to find out exactly what to do with it.
    Thanks again - I have a pretty busy life and am having to fit this in the gaps...

  • OK, made a bit of a mistake but I think I will be able to recover. See attached no. 6 date

    I saw the 1st October date but missed the June date for sending over evidence. I called the court who told me to send it over anyway but that they (the claimant) may complain. Without going into further detail I bumped into a friend with a legal background who told me to add "if there is a problem please let me know" which will help. 

    So, now I think I send over the document with all the pictures. I can attach it here again if necessary...
