95Rollers said:Yes and that sign takes about 9-10 minutes to read. You cannot read it from a vehicle so you have to wait for a space- which are tight and angled - park the car, locate one (that isn't dirty/ faded or in a high, well lit and safe enough place to read- which took me 9 minutes when reading it blown up on my computer so trying to take it all in (not to mention absorbing it) so it will pretty much take you over the 10-15 minute grace period by which time the !!!!!! have already stung you regardless of whether you pay and display, or leave due to payment issues or not being around to find a space or not agreeing to terms or being sure of them. Basically motorists are set up for a fall!Agreed!I had to go back to take a picture of it in order to actually read it as they are awfully placed. This particular one was far too high for me to make out.Thank you again for your help. I am interested to hear how you get on should they take matters further.2022 NSD: 0/202

So imagine you did see it at the carpark and were able to attempt to read it...
Me personally reading it blown up on my computer took nearly 10 minutes. I am fairly well educated (not that you'd think it by reading my posts!) and don't have any visual impairments or recognised learning difficulties and English is my first language- so what chance do people without these advantages/ privileges got!?! That's nearly 10 minutes READING and trying to take it all in - not to mention absorbing it or understanding the jargon/ terminologies used!
But back to your situation - I was reading it at eye level blown up on a large screen less than 2 foot in front of my head - not in a dank dirty poorly lit underground carpark with the disorientating distraction that is the overpowering stench of urine, faeces 💩 (presumably human!) and linger of smelly class A and B drugs - whilst trying to get your best squint eyes on so you can view it over the top of a tightly parked vehicle whilst continually watching over your shoulder for moving vehicles and undesirables!

I agree, took ages to find that line allowing the ten minute consideration period.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So that is an OPS sign ?
Such a sign must be a huge embarrassment for the BPA ? Don't they audit this bunch, I mean the BPA don't have to travel far, it's only 17 miles away ??
And the BPA wonder why people think they are not fit for purpose and probably incompetent. Or as some think more incontinent
Fancy the BPA lending their logo to such utter rubbish, kids could a better job

Makes you wonder what the BPA criteria are that make a sign pass or fail one of their 'audits'? A bit of transparency from Haywards Heath wouldn't go amiss! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Here is a pdf image of the Vantage Point sign which doesn't include the 10 minute consideration period to buy a ticket. OPS have used this in their witness statements.

Will do - I have a post up on the board and I will add to it whenever there is any updates. Its now at the court stage - my defence was filed spring this year and they sent their reply to defence in the Summer. Then last month I was given a court date for early next year and they submitted their Witness Statement which appeared to be Copy & Paste job from their other cases and I submitted my Witness Statement after scrutinising theirs and pointing out all their contradictions, non-truths, rule breaches, poor signs/ ambiguities, lack of due dilligence and unreasonable behaviour by them and their partners (DCBL/ ZZPS/ QDR). They submitted a Supplementary Witness statement with a photo of the "JustPark" sign and its just a waiting game now to see if they will pay the £25 or £35 for it to go to hearing or let it discontinue. I am personally prepared and geared up for the former option so its just a case of waiting and seeing. They've recently discontinued cases that were probably more so tipped in their favour than ours so who knows!? I will keep you posted on my own thread so it doesn't get mixed up with your case. Parking Mad posted a bunch of in-forum links to Vantage Point charges on Page 1 of this thread and mine is in there. But anyhow worst case scenario this is what to expect if its not killed before then! But I would advise reading those threads when you get spare time as there is some good nuggets of information to draw from.3 -

But the Circuit Judge read very little of the statements before the hearing (so he admitted) and proceeded to lap up every word uttered by a barrister who relied on 120-year-old long-outdated 'case law' about 'ticket cases' and carried over the line a diabolically badly-evidenced parking case that I'd previously won on all counts.IMHO, parking cases should never go near Circuit Judges. It is my belief that they simply don't get it, do they, not like experienced District Judges, who know exactly what a clear and prominent parking sign and proper evidence pack should look like and why PPCs must show landowner authority...and not sign it themselves.
Keep these cases out of the courts in future and have a truly independent and clever set of adjudicators and most of the more incompetent PPCs won't know what's hit them in 2022.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We know that it will not be long before the IPC will be DODO dust on display in Chester zoo but are government serious about the BPA being an ATA ..... whoever it is, it's got to be SHRINK time

I always wondered why they have an IPC logo on their signs when they are not members of it and belong to the other ATA of the Cartel!?!? I've not seen this other parking companies signs. I have my suspicions...2
