    (then)?

    Just checking  -  para 5  -  have not read all the thread but did you mean to put "RK" (and not driver)?:-

    Para 5 - I did mean to put RK. 

    I emailed them stating that I was "not supposed to be RK" as the car was sold to a friend, and provided the driver details. 
    Extract from my first correspondence. 

    I would like dispute the above debt from your client
    I was not the driver at the time of the alleged contravention.
    I was not supposed to be the registered keeper either as the car was sold to a friend.
    Moreover, I was abroad at the time of the contravention (Please see attached booking confirmation).

    I would like to however supply the name and address of the driver, so that liability can be transferred to the correct individual.
    The name and address of the driver is: XXXX

    They took that to mean that "I was the RK" and wanted evidence I was not the RK at time of the PCN. I corrected them on the following correspondence. 

    Hope that makes sense?

    Yes it does.  You cannot have been liable and by naming the driver and providing a serviceable address for them, you'd done all that the POFA requires.  They cannot revert to pursue you, if the driver doesn't bite.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Something just dawned on me.
    I sent the WS to the DCB Legal and not to the PPC direct. 

    Have i messed it up?

    It should go to the court and the claimant's solicitors (or legal department if they are using in house solicitors).

    Yes it went to the courts the Claimants solicitors. They do not have a legal department from my research. Only seems that Parking Eye have their own in-house legals

    Some advice needed. 
    Just to refresh memory - this is a counterclaim - the original claim has been dropped by the PPC. 

    I got a call from the local courts this morning and paid the hearing fee. 
    I just received a call back from them now stating because I am not the claimant, I cannot make payment yet. The deadline has to pass first to allow the claimant (which is still the PPC) to make the payment. 
    They have taken my card details and promised receipt of both payment and refund to my address and email. I took down details of the person whom i was speaking to (i.e. their name and their position). 

    However not sure now - because deadline is next week, and should it pass, is it still possible to pay hearing fee?
