  • Yes I saw KeithPs post, just wondered if the deadline to submit a defence changes depending on when you submit your AOS. B789, it is easy to insult someone from behind a computer screen - no need to try and belittle my intelligence. This is all very new to me so might need to double check certain details every now and then.

    It doesn't.

    The back of your County Court Claim Form tells you:


    Note the last sentence there - "The day of service is taken as 5 days after the issue date shown overleaf".

  • Thanks, wasn't exactly sure what 'date of service' meant but that clears it up. I'll make sure to refrain from asking questions in the future.

    You can ask questions but be sure to check that it hasn't been answered already on your thread or in the NEWBIE sticky.

    Remove any thought that there is any human thinking behind these bottom dwellers. It's a simple automated process run thousands and thousands of times over. It's a scam by using the legal proceedings. The business model is issue ticket, ignore appeals, threaten court and hope this makes people pay. Their letters/processes are automatic it doesn't matter what you do. 

    The goal is to scare you into paying, or tiring you into paying. It works a lot to, but you've already won because you've found this forum. Stick at it. I've been through it I know the stress, but once the other side of it you can see the scam for what it actually is. BTW they cancelled both court appearances a day and a week before the hearing.

  • Hi, slightly panicking! @KeithP stated the deadline for filing my defence was Monday 23rd September, but this is actually today which is a Saturday! I have drafted my defence, but have I missed the boat?
  • Sent off my defence and have received the automated email despite it not being a workday or work hours. Let me know if I have done this all correctly.

    Yes, sorry about that.

    In my post of 24 August at 11:01PM I did say...
    ...you have until 4pm on Monday 23rd September 2023 to file your Defence.
    Two things wrong there...
    1) obviously 23rd September isn't a Monday, and
    2) I should've written 'Monday 25th September'.

    In the court system, nothing is ever due at a weekend or a bank holiday.
    I half adjusted the date - got the 'Monday' bit right - but didn't change '23' to '25'.

    Clearly I got it wrong. Sorry about the panic I caused and no you haven't missed the boat.
