Looks like a really good BPA firm example of a WS that we can direct people to read.

Thanks (it does mean you might get loads of notifications that we've mentioned your name).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We have another Winner Winner Chicken Dinner!  :D

To clarify in the end I never even got to submit my WS Bundle, however as mentioned previously DCB Legal Ltd called me a few weeks ago asking me if I was interested in a "Without Prejudice" settlement and then also the other week I received and email advising of similar.

I know the advice is to not make contact, but I decided to email back with a "Without Prejudice" offer of £0.  Of course I have no idea if any of this had any influence on the N279 Notice of discontinuance, and this may have happened regardless, but I just wanted to disclose this information.

Is it even worth proceeding with a Counterclaim?  They have discontinued much in advance of the actual hearing, so I would think not?

    Hooray!

    ANOTHER ONE BITES THE DUST!

    Well done snd congrats!

Please do stick around and return to browse here once a week, so you know when the final (honestly, really final) Public Consultation takes place.

We need teal victims to answer the questions to make sure that the Govt has evidence from people really impacted and distressed by this horrific industry, to support the plan for lower parking charges and the BAN ON THE FALSE DEBT RECOVERY EXTORTION.

Many thanks to all who helped @keithp @Redx @patient_dream @Le_Kirk @Umkomaas @Jenni_D @Coupon-mad and anyone else, you all helped and gave me confidence to fight against this PCN!

@Coupon-mad I do hope the Public Consultation does finally take place and is in favour of the average Joe!  The PPC's clearly need to be put in order!

Well done. Once again a DCB Legal case collapses when they realise their client has no case and the defendant knows that and will defeat them at court. Add to that, that UKPC have been doing a lot of huffing and puffing with court claim frighteners, but we've seen no case that has come our way reaching a courtroom. Bullying in the extreme - when there's the risky of a bloody nose, the bully turns and runs away.
Is it even worth proceeding with a Counterclaim?
Did you notify (and pay for) your intention to counterclaim and the reasons for doing so as part of your Defence, you can continue and the claimant is required to defend, or they lose and you get paid.  But if 'counterclaim' is a metaphor for claiming your costs of defending, forget it.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It needs the average Joe to comment with their first hand experience. Forum regulars have already been through two gruelling previous consultations, we need a helping hand from more recent victims to get this over the line again. If there is a failure, the case you've just won is unlikely to be your last, as PPCs and DRAs will run riot. We cannot afford to let that happen.

@Umkomaas no unfortunately I did not notify or pay for intention to counterclaim!  So it looks like I'm snookered!

There will be another one very soon.

The Government has conceded they need to consult again because the PPCs threw two Judicial Reviews at it:

    https://www.racfoundation.org/media-centre/firms-fight-back-against-reforms-to-parking-on-private-land

I've heard it from the DLUHC in person (virtual meeting) and the Code of Practice page tells us this too.

Final Public Consultation about to take place this Summer/Autumn followed by an Impact Assessment.

Specifically about the level of parking charges and the false DRA 'fees'.

You can imagine the stats 'alternative facts' and surveys the parking industry is going to commission and chuck at this to try to change the Government's mind and make no mistake - THERE IS A REAL DANGER HERE.
