I note (from reading back through the thread and I suggest you do the same) that you appealed to UKPC and it was rejected.  Did they supply a POPLA code and did you appeal to POPLA?  What happened?  You are in the same position you were in in December, waiting for a letter of/before claim.  Regarding those letters from debt collectors or those companies posing as solicitors but actually are debt collectors just file them under "take no action".  If you want to get a jump on the situation, you can read the defence template and start putting together your defence based on the claims on the PCN.

Am I still able to appeal to POPla for it after all this time (good few months). Yes, I think I'll read the defence template, cheers.
Far too late to be considering PoPLA. One is allowed 33 days from the initial appeal rejection to appeal to PoPLA.

Yes, your next action is likely to be responding to a Letter of Claim, followed by compiling a Defence.

Or you could try PLAN A again (landowner complaint, as per the NEWBIES thread).  Never too late.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi all, looking for the latest guidance;

so my latest letter is from VCS, a chunky one this time LETTER BEFORE CLAIM.
It says they have no alternative but to commence legal proceedings, despite best efforts to recover payments.

Asks me to pay £170 within 30 days, and if not, legal proceedings will commence.

I have forms to fill in relating to court, boxes to tick, information about all the organisations I can contact for help. how I will pay, what my earnings are in 'Standard Financial Statement'.

As per coupon mads last suggestion, I can't locate the landowner, as it is many shops with a car park outside.
Specifically for tesco it's just always a few young staff on the tills and never a manager.

Any help on steps to take at this point appreciated!

Comprehensive guidance on how to respond to a Letter Before Claim can be found in the first few paragraphs of the second post on the NEWBIES thread.

Cheers - I've been in the newbies section a good few times before now, it just gets a bit disorientating but that's great thanks for reminding me.

I know Tesco well. You could still get them to cancel, but what you do not want to do is talk to the checkout operators, floor staff or even customer dis-service. You need one or both of local store manager or CEO. Don't mess about in between. They may not help, but if they think you are a really good customer who will go elsewhere and advise family, friends, work colleagues, acquaintances and the family dog to do likewise, there is a good chance they will.

With a Letter before Claim, you need to send subject access request to the parking company, and a 30 day debt hold to the legal lot. DO NOT fill in and send their prying little forms.

It is all at the top of the second post in the Newbies

VCS? This thread is about UKPC, a completely different parking company, but just as nasty, and a member of a completely different trade association.

If the LBC is for a different PCN, then you should start another thread as the advice will be different.

    Please clarify.

As for Tesco, have you complained to the CEO?

I married my cousin. I had to...

Great that, thanks for the info.

I currently have a couple of these tickets and I had actually confused the two.

This LBC is from an event parking in the Gym car park and being charged for it, even though there's hundreds of bays that are free. Some crafty little landowner bought the land right in front of the gym and charges for parking there. All the gymgoers getting done by it.

Anyway, I will just do the same process with this. Just about to do my SAR to Excel.

    Thanks again

    Please do take care.

Not only did you throw us off track by mentioning VCS on a thread about UKPC, but now you are talking about sending a SAR to Excel - a third company.

OK, VCS and Excel share officers and premises, but they are two separate companies.

    I've located this information.

For yourself and anyone else reading:

Am I supposed to reference the parking 'offence' in the generic text I am using from the newbies thread?

    Is this ok for example:

    Dear Sir or Madam

With regards to letter with reference: ***********

Please supply the data about me that I am entitled to under data protection law relating to myself.

    Please also include:

ALL photos taken at the site, all letters/emails sent and received, including any appeal correspondence earlier, whether the car park was Pay and Display, The records of the PDT machine for that day, the payments made, all data held and a full copy of the Parking Charge Notice, and Notices to Keeper.

Any claim made against me must only be for this specific parking charge notice, and no others.

If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.

If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.

    Yours faithfully
