  • The court auto reply includes the following:

    "TRIAL BUNDLES

    Parties are to ensure to lodge their trial bundles at the court an indexed bundle of documents contained in a ring binder and with each page clearly numbered not more than 7 days and not less than 3 days before the start of the trial and in compliance with the president’s Practice Direction on Court Bundles. Following recent directives from the any sitting Judge, the court are unable to printout e-bundles for Civil And Family cases, therefore your email will be disregarded and it may be suggested to submit the documents by post, letterbox dropbox at the entrance or DX. Please read the attached “Annex A  HMCTS Notice on Court Bundles and Papers”"


    Does this mean the email does not suffice and I need to send it via post?

    If you have sent it to the claimants solicitors as well as the court it is normally expected that they would put the bundle together.

    But I'd supply a paper version in a ring binder anyway, this week. Take it in person and put the binder in a very large envelope with the hearing date & time, and the claim number on the front along with the words 'URGENT - DEFENDANT'S HEARING BUNDLE.'

  • Okay thank you. They haven't actually confirmed a hearing date yet, they said this will be sent later. So should we wait until we have confirmation of the date/time, or just take in a paper version given they've asked for documents to be supplied by 28th April? It says not more than 7 days before the start of the hearing, so a bit conflicting which to go for!

    We'd need to see both those Orders - exact words - but isn't it easier just to print it all off now that it's fresh in your mind exactly what was emailed?

  • This is everything I've received regarding filing... Everything else I read online seems to suggest you can file via email, however their auto response is throwing me. 
    The court is not near me it's near my mum as she is the defendant, therefore not so easy for me to go there, however I can get her to if necessary. I've been trying to ring the court to clarify but they never answer it just rings out.
    Given the images above, what are your thoughts?

    As you have a week, why not post a full copy, securely in a soft plastic-fronted small ring binder, with the date and time of hearing and the claim number on the front?

  • Yeah think I might do that just to be safe! Although we still do not have a hearing date, so hope they won't disregard it because of that..

    Instead attach a copy of the order at the front, and put 'Defendants witness statement and evidence - claim xxxxxx'
