UKPC Court Claim -Not parked correctly within the markings of the bay or space

    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information 
    7. Contact The Land Registry and for around £3 they should be able to provide definitive detail
    8. If you haven't already done so, give us the name of the car park, we may have seen other cases there. 
    Hey I have tried googling, but was wondering if anyone has heard of Southall VHK and who the landlord is? Currently disputing a pcn with parking eye there where parking eye still got the money!

    You haven't mentioned it, but have you filed a Defence yet?

    I filed my defence on the 28th December. I’m hoping it was enough but only time will tell now. I’ve had a letter from the court to say they’ve sent a copy to the claimant and who have 28 days to respond. 

    I’ll check the MCOL website again today and see if anything’s on there.

    It was late but it seems you got in first , so your MCOL claim history should show Defence received and logged etc , so you are awaiting a DQ from the CCBC in Northampton , your Claim history will show you if or when it is posted , even if it's this month or next month !

    Would only apply if you were "parked" in a bay or space.  Not if you were on a random piece of roadway with no forbidding notices, signs or markings?!?  I always thought that "contravention" (I used inverted speech marks because it is not actual statue law or a real "offence") as a way of penalisation for people who parked over white lines or across multiple bars (sometimes selfishly without reason and other times due to unforseen circumstances- I.e a selfish Parker or oversized vehicle or a skip taking up bays etc).  But by the wording of that I would suggest that the "parameter" would be a marked/ designated bay - not anywhere outside it.

    Hi Everyone, 

    I filled out the directions questionnaire in February and I’ve heard it can take quite a while to hear anything from the court. 

    I just have a question though as one of the “offences” is now over 6 years old (two PCNs in total, February 2016 and July 2016). 

    Will the court continue with the case if proceedings have already started?

    The Limitations Act 1980 provides 6 years (5 in Scotland) for court proceedings (the issue of the claim form) to commence. Once started within 6 years, it can continue to proceed to trial.

    Have you checked your MCOL status page to make sure that CBC acknowledged receipt of your DQ?
