I said to the estate agent is probate sorted (I know it takes ages as we needed probate when my Nan passed away and the house was left to us in the will to sell) and the estate agent replied probate isn’t needed. So don’t worry about that then I’m pretty sure she said although I was looking at other stuff that the house was is the childrens name. As I heard her say to my sister a lot of people do that so they don’t have to deal with probate.badger09 said:
Who is 'she' who said Probate is not needed? It is easy for beneficiaries to misunderstand the legal process.charlotteo1988 said:
I don’t think it’s needed as the house was left in their name. But it was also 9 months since the parents passed so may of already got probate but when asked I swear she said it’s not needed.martindow said:
Why won't probate be needed? Possibly it has already been obtained, but I don't think the executors will be able to sell the house and distribute the proceeds without it.charlotteo1988 said::
I meant no probate needed not private lol.
So PLEASE get confirmation that Probate has been granted, or alternatively, a clear explanation of why it is not thought necessary. You should do this before you burn your bridges on the other property IMHO.
However I will double check tomorrow. Even if probate was needed 9 months is plenty of time to of had it back. The property has only been on the market 3 weeks but the parent apparently died around 9 months ago. Thanks for your advice.0 -
