    Hi all,

    Finally got a court date come through for the middle of next year - they keep sending me letters saying 'pay now for 25% off' - honestly just naff off already.

    I found this doc published by BPA saying about having a "mandatory" entrance sign - would that be something worth submitting to the court (& to BW Legal I believe) as there are no signs whatsoever at the entrance.

    If you can get a picture of it from the time of your event (Google street view is your friend) that will be brilliant evidence along with the BPA document, provided, as others have said, that is is a BPA PPC and not IPC.
  • Hi guys,

    So the time has come to go to court and I've received a book of what their solicitors have submitted to the courts.  They have rubbished most of the defence.

    The only thing I have is about the entrance sign - I checked on Google maps and it looks like it may have been there during that time, but has since been moved - and the only reason I can think that it would have been moved is because the text isn't big enough as per the BPA Code of Practice - this car park is entered from a 30mph road.

    I've not been to court before and don't know if this would be enough to win.

    What do you guys think?

    Your WS should include everything you wish to rely on at the hearing. You might get away with sending a supplementary WS if you find something in the claimant's WS you want to challenge, but anything sent after the court mandated deadline might be thrown out. Either side can complain about anything sent after the court submission deadline.
    Judge's don't like people playing WS ping-pong.

    We know you've done your defence ages ago but we weren't asking about that; we were asking whether you've yet submitted a WS bundle?

    That is why I asked earlier CM, I was slightly concerned that we hadn't seen any sight of a WS!

    And why would you do that? Even if it went in front of a judge and you lost, you'd still probably pay less than the claim amount because it has been inflated with costs/damages that are not allowed in a small claim.
