    With a Claim Issue Date of 26th November, you have until Wednesday 15th December to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS in a timely manner, you have until 4pm on Wednesday 29th December 2021 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

  • It says in POFA that:

    The maximum sum which may be recovered from the keeper by virtue of the right conferred by this paragraph is the amount specified in the notice to keeper under paragraph 8(2)(c) or (d) or, as the case may be, 9(2)(d) (less any payments towards the unpaid parking charges which are received after the time so specified).

    So some of the amounts must be non-chargeable because it's up to over £200 now

  • The first PCN says £40 discounted then £70 if not paid within 14 days - so the maximum they can charge is the £70 right - got a +£20 initial debt recovery on the final demand, which then rise to £54 that are 'detailed in the car park signage t&c's' once BW Legal get involved.

    Guess I'll have to argue that £40/ then £70/ then £90 for 18 minutes additional parking seems a bit excessive.

    Up to now most of your conjecture and suppositions won't work , due to a lack of research

    The Beavis case may provide some assistance , but not the excessive charge allegation

    POFA assists a non driving keeper , not a Keeper who was also the driver

    Poor and inadequate signage and no landowner authority are typical defence arguments , the CRA too , plus the relevant BPA CoP

    No, it's £70 plus permitted legal costs of £75 - £100. Anything else is fake add on amounts.
