Evidence comes later - when you file your Witness Statement.3 -
So I submitted my defence and I've received a letter from BW Legal - Notice of intention to proceed - in it they say that their client is confident that the court will find in their favour should the matter proceed to a court hearing. If their client's claim is successful at such a hearing, then it is likely that a CCJ may be entered against me. So if I lose I'll get a CCJ?0

No you will not. This is more BW bull***t. IF you lose but pay in the required time, there will be NO CCJ on your record
Edit to add - they are just trying to spook youThe pen is mightier than the sword ..... and I have many pens.3 -

I've got all the letters - it's a whole file full - bloody ridiculous - well I'll let you know when I receive a court date - it's been a while since I've had to go there!1

I've now received a Directions Questionnaire, which I must return to the court - anyone know if this can be done online? Also, is the mediation service worth my time or will they just still just try and get a load of money out of me - if that's the case might as well go to court.0

If you used the standard defence template and/or read the NEWBIE sticky did you come across this list: -6. After filing your Defence, there is more to do.
7. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire and the usual intimidating template letter saying they 'intend to proceed'. Nothing of interest there. Just file it.
8. Wait for your own Directions Questionnaire from the CCBC, or download one from the internet - https://www.gov.uk/government/publications/form-n180-directions-questionnaire-small-claims-track , and then complete it as described by bargepole in his 'what happens when' post linked from post #2 of the NEWBIES thread - https://forums.moneysavingexpert.com/discussion/comment/64350585#Comment_64350585
9. The completed DQ should be returned by email to the CCBC to the same address and in the same way as your Defence was filed earlier.
10. Send a copy of your completed DQ to the Claimant (or their solicitor if they are using one). Their postal address is on your Claim Form but you can find an email for them by searching this forum, or Google it, because a DQ sent by email is OK and then you know/can prove it's been sent. That should give you all the answers you need.

Hi all,
Finally got a court date come through for the middle of next year - they keep sending me letters saying 'pay now for 25% off' - honestly just naff off already.
I found this doc published by BPA saying about having a "mandatory" entrance sign - would that be something worth submitting to the court (& to BW Legal I believe) as there are no signs whatsoever at the entrance.
As always thanks for all your help.1 -
I can't see the link on my phone but the BPA Code of Practice can certainly be used in evidence as long as the PPC Claimant is a BPA AOS member, and not IPC.
You've been away from this forum for a long time and much has happened in 2022 re the proposed new DLUHC Code (currently stalled but worth also referring to).
The current position is as shown in the WS bundle example by @aphex007 and NOT the example WS linked in the NEWBIES thread.
Obviously nothing gets sent to the CCBC.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If they have such a strong case then why are they trying to buy you off this early? They wanted court, so court they shall get!2
