Found CCJ awarded against old address despite the company knowing my new address.

    Have you considered a claim agaist the PPC for breaching your  data?   It could be worth up to £500, read this

    Was the CCJ removed from the record?
    Yes it was and I have been issued with a certificate to prove it.  My credit score was restored immediately too.

    I am all for claiming but it is very time consuming and still a risk (court fees) when so many judges do not seem up to speed with GDPR (Art 82).   I was awarded £200 plus costs by the DVLA - I asked for £500.  I was still pleased because of the win rather than the amount.  

    OP has done amazingly well here for not giving in and I think will be happy to move on.   Wording on the emails expressing a clear breach of GDPR did the trick without the need for court action - although OP was up for it if necessary.

    I hear on the grapevine, that Keller Lenkner’s senior associate says that they are intending to launch a further group action against the DVLA, known as DVLA2 under the heading ‘bad processing’.

     

    They are looking for around 100 potential claimants who fall into any of the following categories:

     

    1. PCN issued when valid ticket purchased (this probably includes other ;no breaches', like double dips).
    2. Court proceedings issued despite PCN being paid/appealed successfully
    3. PCN issued by unregulated car parking company
    4. PCN issued against previous owner
    5. PCN issued where faulty ticket machine meant individual could not purchase a parking ticket
    6. PCN issued against incorrect vehicle (ANPR fault – picked up incorrect reg plate)
    7. PCN/Court proceedings sent to wrong address

  • I’m a fan of group actions (when there is no risk to the individual). Yes the lawyers take a large slice but it can be worth it - BA data breach for example.  If you hold my personal data you had better be careful with it!

    This is the law firm I contacted before Christmas.  They confirmed this afternoon that even though I have been refunded that they will still include me in this action on a no win no fee.  I feel that it is important to carry on so that others are not affected as I have been.  I was in the fortunate position to be able to afford to pay the fees and fight to be refunded.  I was also lucky that I am subscribed to Credit Karma, so was alerted immediately of the CCJ and able to pay it so it did not do any lasting damage.  I do appreciate however that for others this might be a very different story and it must be terribly traumatic if these cowboys' actions impacts on peoples' lives hugely.

    A great stance and your case is a good example for the group claim, because by refunding you, the PPC have effectively admitted data processing fault and that data can be traced back to the DVLA, who hand out keeper details like sweeties and should have been FAR more robust over the years.
