Found CCJ awarded against old address despite the company knowing my new address.

    There aren't many but there are some claim threads here where people have raised a GDPR claim against a PPC. Raising a claim itself is easy - it can all be done online via MCOL (the same way the PPC raised their claim). You need to be sure you name the correct defendant (the PPC, so get their correct full name and address).

  • Well I have paid and an additional fee of £14 to ensure that the courts write to CEL so it will be removed from my record.  Next step now to reclaim the money from the thieving gits! :(

    Thank you pm sent to the above - I have emailed my mp and am now looking at how to reclaim.  I do have the fight in me, but it is a mine field. I wonder if I can charge for all my time?
  • OP contacted me and we are going through the process of trying to recover her money.  Highview caved in with me and repaid me before court as I discovered Ian Langdon controlled both car parks.  I had parked (and paid) in one of the two reasonably  believing it was all the same car park as there were no signs.  I only asked for the charge as it was before GDPR.  It was ‘only’ £40 but I intended to pursue it to the end despite being threatened with costs.  Highview paid my court fee on top.  

    OP has a good case for breach of GDPR but we are not complacent as we know the law can be an a**.

    I am very pleased indeed to report that I have just found a cheque in my postbox from Civil Enforcement Limited for the full amount.  It took a few emails, but I stood my ground and got there in the end.  Thank you to everyone on this forum for their time and support, it is lovely to see that not all of society is rotten  :)  Happy New Year!

  • I'm not very adept at these forums so thanks to both Coupon Mand and zhonguonuren for their help and the tagging.  

    To my surprise they acknowledged my initial email that was a straight forward can you please refund me, as I believe that you falsely obtained this judgement and therefore had no legal right to the monies I have paid you.  A short exchange of emails then took place where they tried to imply that the judgement was against another vehicle I owned.  

    Here are the last 2 emails I sent, neither of which they responded to, other than to simply send a cheque in the post. 

    As I said in my previous email, I dispute your claims and have emails and written correspondence that disproves your claims, which will be produced in court if necessary.  The correspondence clearly states my current address and the vehicle registered below, so why you chose to use my previous address is obviously down to a failure in your company’s systems.  

    Just to clarify I was not the registered keeper of any other vehicles at that time and therefore I repay me request that you refund the money, which was obtained illegally.  

    Final email:

    I reiterate my request for you to refund the monies illegally obtained, please see the email chain below.  I note that a considerable amount of time has passed since this request was made and if it is not resolved within 5 business days I will seek to reclaim the money and all additional costs incurred through the courts.

    I do have written correspondence from them at my new address and it was obviously an admin error that saw the court papers going to my old address.  However, obtaining the refund was thankfully much more straight forward than I anticipated, although in terms of principles it still riles me that a CCJ was obtained against me.  This is an area of society that needs addressing.  You couldn't be prosecuted for criminal activity without your knowledge, so this whole court system where you can be tried and convicted without your knowledge is mind boggling.  I never had a response from my MP, but that is not surprising either.

    Anyway thank you again to everyone who took time to message, particularly to zhonguonuren and I hope that this gives hope to others.
