  • Looks fine now and thanks v much for the vote of confidence about how easy it is once you get started!
    Will submit tomorrow.

I think inevitably we turn up here I a bit of a state... Annoyed. Concerned. Uninformed. Takes a bit of time to calm down and get over that.

Also the forum tends to have current running claims up front and it’s nice to see some of the successes and how they progressed. Hopefully this will be one of them.
  • As an update I received a letter from DCBLegal stating the client intends to proceed with the claim. The also sent a filled out N180 form. The newbies thread says I should now wait for the court to send me an N180 and post that back to the court and the solicitor so that's what I will do.

    Cheers

Standard copy and paste from DCBL trying to scare you ...... does not mean they will win though

Send the DQ back to the CCBC using the same e-mail address that you used for your defence and if you have an e-mail address for the claimant do it on the same e-mail.
  • Hi, I havent't recieved the DQ from the court and its been 10 days. Should I just find the form online and send back by email or am I fine to wait for this to arrive?

The CCBC sent you a letter, or will send you a letter, saying the Claimant had twenty eight days to consider your Defence.
What you don't know is when the CCBC sent a copy of your Defence to the Claimant.
It follows from that that it is not known when the Claimant has to respond to the CCBC.
Further, we don't know what delays there are in the CCBC that means they don't send you a DQ as promptly as you might like.
Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course.

I have the response from the claimant dated the 13/01 with their DQ. MCOL hasn't got anything after "Your defence was recieved..." (mid december).

So if I understand correctly the MCOL would update to reflect the response from the claimant. So if it doesn't say anything then CCBC probably havent processed it yet?

Thanks for your help. I hadn't even thought to look on MCOL.

Exactly , always check the MCOL claim history first

If they haven't posted it , then it's too early

Keep checking MCOL claim history for it being posted , then download it and fill it in and email it , not before

Alternatively , go old school and wait for it arriving in the post

These processes take time , especially due to covid , so you may have to wait weeks before there is any movement
  • Hi

The MCOL now says DQ received from claimant and “DQ sent to you” at the end of last month.

I haven’t received anything. I tried calling HM courts and tribunals but the wait is too long and I suspect I don’t really need to speak to them.

I assume I should just proceed with filling out the DQ? Is there a time limit on the DQ as is he rather annoyed if I go past it because they failed to post anything.

    Thanks.
