How is this possible?

Hello, can someone tell me how this is possible
I work for a fairly big haulage firm and have over the last week covered my boss who is of with Covid and I have seen something I have never seen before
What appears to be happening is that the drivers don't pay for over night parking at various moto and road chef sites which normally costs £25 for the night.  They do this with the intention of getting a parking notice
The parking notice is then received and they pay some bloke from Birmingham £10 for each one and then each ticket gets cancelled (apparently he has never failed to cancel these particular tickets) so the company saves £15 a time and this has spread to several other haulage firms
How on earth does the company and the guy who does it get away with it? has been going on for years by the looks of it and not done by accident
Thoughts?

  • I should add it only appears to involve one parking firm who has changed their name (Cp plus - Nexus)

Sounds like fraud to me , so I won't be giving any opinions about it

That's why I am asking, it seems like they are intentionally getting a ticket as the person he uses knows he can get them of and does it by the dozen.  I haven't said anything to anyone else in the company and its interesting it doesn't seem to involve any other parking firm

If it is fraud, the entity being defauded is surely the PPC.  I would  not lose any sleep over that.

I think when my boss is better and back at work I will have a quiet word with him and get him to pull the plug on it

How are the drivers personally receiving the Notice to Keeper from Group Nexus?

Presumably your company owns/leases the vehicles and they will be the registered keeper of each vehicle?

How are the drivers benefitting from the 'fiddle' you describe?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The company owns all the lorries in question. (the only thing not owned on them are the tyres!)
The company receives the notice to keeper and emails it to the person he was using to deal with them.
From what i can tell they don't get any benefit, it is simply the company benefiting by paying £10 instead of the full over night parking rate

If the PCNs are cancelled then surely the  RK does not pay a penny.  Who pays the £10.

Yes they pay someone to get these all cancelled. The company pays this bloke £10 to get them cancelled and he sends a weekly invoice for the tickets being cancelled.  From emails ive managed to see he doesnt appear to appeal any others

So, is there a victim here?   Does the MSA lose £25.
