Well be that as it may it still can't be classed as mis-selling to my mind.Having had a quick Google I think this might have been a retention sweetener for when they had a cyber-attack on the website a while back. But of course there is no such thing as a free lunch so...0

your neighbour may never have agreed to sign up to a new contract - particularly if she does not recall going on any webpages or phone calls to this effect
On the talktalk community boards there are reports by people who were charged for their free upgrades, told they had signed up to new packages and then eventually refunded the difference. A new contract isn't a free upgrade and you were right to ask here.I can't post the link here but will try to PM you.
next time try the talktalk community boards where you will meet others will the same experiences - and also people who will believe you when you are questioning if TalkTalk is acting legit0
