Missed witness statement deadline yesterday anything I can do?

I’ve just received the evidence bundle and witness statement from DCB legal today and this has alerted me to the court date being 2nd December which means the 14 day deadline for witness statement being yesterday. I can’t tell you how stupid and disappointed I feel, the court date was given in September and stupidly I didn’t put any alert in to remind me about the witness statement deadline. Huge mistake.
I haven’t even started the witness statement yet either. 

is there anything I can do now? Or do I just pay them their extortionate fees due to my mistake? Any help would be so gratefully received.

  • I’m in the process of doing it now. I fear that I don’t have a good “narrative” of what happened as this is one of the highview cases for a parking fine issues in 2015 and I have no recollection of occurring.

    Can I post photos of their defence points and get advice about anything I should put specifically in the witness statement/be prepared for the court hearing? 

    Feeling a bit overwhelmed by the lack of time and the way their defence is written.

    According to this 24 June at 2:27PM you sent your defence on 31st May; your witness statement has to back up and support your defence, therefore pull out your defence and write the narrative (story) of what happened on the day and subsequently and provide evidence to support it, such as your photos of any misleading, poor, illegible or missing signage etc.  There are example WSs to follow as indicated by @Coupon-mad above.  NOTE they are suggestions and examples of style and format not to be blindly copied and pasted because they won't relate to your case exactly.  WSs are written in the first person.

    please keep ALL posts about the one issue on the same thread/discussion as it causes the regulars to jump about all over the forum and they might miss important information and also fail to answer another poster whilst they are dodging about all over the place for you.

    Three threads?  Surely you only need one!  Have you complained to your MP?
    You never know how far you can go until you go too far.
  • Oh goodness, what a muddle with starting three threads really sorry. (I can delete or amalgamate if there is a way). 

    I’m getting on with the witness statement and will send today (my little one and I have come down with a wonderfully timed sickness bug so it’s taking longer than I would have liked! 


    Question: DCBL have sent a witness statement on behalf of the landowner (no contract). Forgive my lack of understanding around the terminology but is this where I would put in the statements I’ve seen in other threads about a redacted landowner contract or is that only where a claimant has provided a part of a contract not tue whole thing. And if the latter is the case is there anything particularly To draw on to add to my witness statement?

    Looks ok to me and likely to a Judge, IMHO.  Don't get bogged down by that.

    Your WS is mainly your story of what happened plus pictures and court cases in support, like in the 2 examples. Or, if true, your story as keeper that this is so long ago it's not possible to know who in the family was driving but it wasn't likely to be you because...you hate shopping, have never parked there, or whatever is true.

    Send it signed & dated, by email to the local court and Highview's solicitors in the morning, it's not something that takes hours and hours.

    The abuse of process for double recovery - (extra £70 in this case) I’ve found some threads to drawn on but my understanding is some of the cases to use may have changed? Which ones should I be using? Britannia v Crosby, Parking eye v somerfield, excel v Wilkinson (the later being the most recent so just that or are the others still relevant too?)
