    As above , no paper , NO filling in paperwork , no posting using royal mail either , AOS online on MCOL , then treat MCOL as read only after that , no filling in any other boxes or sections on MCOL , everything is done by email after the AOS is done , unless anything changes

    If you lose in court , pay in full ASAP what the judge orders you to pay , to the lawyers acting on behalf of the claimant ( or the claimant if no lawyers ) , definitely within the 30 days , to avoid any CCJ being recorded , it's a grace period to settle the matter once and for all

    There is zero CCJ risk to anyone following all our advice, even if they lost, because you'd then pay less than the claim, as I said.

    Not so much as a smut remains on the person's credit file in the rare case that they lose.

    The Defendant must of course meet all court orders and deadlines which is covered in the red heading section in the NEWBIES thread 'IMPORTANT - KNOW WHAT HAPPENS WHEN'.

    We wouldn't (and we don't) put people to that risk and if your thinking was true about getting a CCJ anyway, no-one would have access to justice in civil disputes.

    These are well worth defending.

  • Hi All,

    Apologies again if I'm asking questions that have been asked before.

    I did the AOS on the 22nd of November. 

    I am getting round to doing the defence now, I know above Keith mentioned having until December 15th to file a defence. But only now have I realised that this was probably based on me filing the AOS on the 1st of December and therefore having 2 weeks after that date to do the defence.

    If i've missed the deadline, do I just crack on anyway? I haven't had anything through the post about anything. 

    Also in regards to the defence itself, are there some good examples anyone can point me towards, i'm aiming for the "parking permit slipped off the dashboard" angle. 

    I will post my defence in here as soon as i've done it, but to be honest, some examples would be great. Half of this journey is to just not let people like yourselves down who put so much work into this, honestly i'd still rather pay a small part and be done with it, but i feel guilty with all the hard work you guys do and the fact that you've all taken the time to respond to me haha.

    I doubt you will find that angle, but plenty of people read successful court claim discussions on here, as should you

    2.       It is admitted that the Defendant was the registered keeper of the vehicle in question but liability is denied.  

    3.       A parking permit was originally on the dashboard but must have slipped off onto the seat/floor. I have parked here many times before and many times after. I have then received no other paperwork until a Claim form has been sent to my address more than a year after the alleged offense, at which point a wild amount of additional charges have been added on and a CCJ has been threatened.

    You need to write in the third person so no "I" but "the defendant".  You need to set the scene for the judge; is it a residential car park or an office space?  Do you have "primacy of contract" via your lease?  Why do you display a permit?  The additional charges aspect is covered later in the standard defence.  The fact that "a wild amount of additional charges have been added" and a "threat of a CCJ" is not a defence.  You could save this for the witness statement if you want to aver unreasonable behaviour.
  • 3.        The Defendant was visiting a friend at their home, the parking spaces available outside said home are permit holders only. The Defendant was provided with a parking permit from their friend. The Defendant placed the permit on the dashboard, however this must have slipped off onto the seat/floor.

    I wonder how the permit slipped off; was it a very windy day or could some "people" have jogged the car causing to to fall to the floor?  Not suggesting that goes into the defence but it has been cited in witness statements before now.  Could you obtain a witness statement in writing from your friend to say that they did, indeed, give you a permit?
  • Ok i understand, so some examples of how it may have ended up on the floor are useful. Will add. Also yes I can get a witness statement in writing, If I do so, would this be for later? Or would this also go into this section right now?
