Hi I've received a letter from UK CAR PARK MANAGEMENT LIMITED. A Claim form for the County Court Business Centre dated 12th November.
I've tried to read through some of the newbie threads and some of the other things but honestly it's a bit overwhelming.
If it's OK I'll quickly explain my situation and if worse case scenario I have to pay, so be it.
I received a parking charge for parking on private property, a while back, I ignored it and I think they sent me a few more letters. I ignored them all (I know this was not the correct way to go about the situation as per the forum, but at the time I wasn't aware).
I am willing to take responsibility for the charge and pay the £100 that from the forums I see I am legally forced to do.
My charge is for circa £270
100 for PCN
70 contractual
15ish for interest
35 court fees
50 legal representative costs
I'm under the impression people on the forum will be familiar with the claim forms they send out.
I just want to know if I send £100 to Gladstones solicitors now and quote my reference etc, will this whole situation just be over?
Do i need to still have to reply to the form officially?
Do I have to go through the whole court process?
I know a lot of people say the same thing, but I apologise if this is a repetitive issue, i'm more than happy to donate to some sort of forum fund for people helping with this stuff, I would rather pay the additional money here than to them.
I look forward to hearing back soon.

No it won't , they will either demand the rest of the £270 , or reject the payment and demand full payment
You do the AOS online , on MCOL , using the government gateway website and official login, Do it tomorrow or Friday , after reading the second post in the newbies FAQ sticky thread near the top of the forum in announcements
Yes you may have to go through the whole court claim process , to a hearing with a judge , next spring or summer , if UK CPM take it all the way , so assume that they will and hope they don't
So you need to do more research and reading etc , if you are going down the DIY route
Use and adapt the template defence by coupon mad , again in announcements1 -

They have added what appears to be an extra unlawful amount for debt collection. Judges have dismissed an entire claim because of this. Read this and complain to your MP.
Excel v Wilkinson
At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims. That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued. The Judge concluded that such claims are proceedings with 'an improper collateral purpose'. This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015. DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

Just to confirm this part, if I pay the £270, it's all done, no CCJ and I can just get on with my life?
I would gladly pay someone to do this on my behalf, but I don't suppose there's anyone on here that would do that for me.

Even if you lost in court , the figure to pay within 30 days is approximately £200 , not £270
Forum members are not allowed to tout for business , or give legal advice , just opinions , which we are doing for free
We never recommend paying a sc*mmer , it encourages them to find other victims
So why pay out £70 more than a loss in court ? Doesn't make sense2 -

I know that I should have responded earlier, but also I know i'm being fleeced.
I just don't have the time to be dealing with this, otherwise I would love to fight them till the end.
Hence the prior reply saying that i'd rather just get it paid and done if it means i'm in the clear.
HOWEVER because of the fake £70, I would offer Gladstones a settlement less the £70 on the basis that there is no such charge as a contractual charge ,, they know this and 99% of these fakes are not allowe by the courts.
The risk Gladstones has is the case will be dismissed as happens many times with them. They are not the smartest page in the book.
You would no doubt win as judges will treat such a case as timewasting because you have a permit albiet it may have slipped off the dashboard.
UKCPM tend to pass these stupid claims to Gladstones but that does not mean they win
We help many people zap the incompetent Gladstones so please reconsider before paying1 -

Why would you pay? It makes no sense and is not what MSE is about.

@KeithP I did not sign up to the site to pay the maximum amount. I originally asked if I could get away with paying them £100 and be done with the situation. The reason my time is tight is because I work 6 days a week and have a newborn. So at this current time in my life, time is a massive issue. However @Redx said it probably wouldn't be as easy as that. I was looking for a time/money effective way to resolve the situation with minimum hassle.
However your messages have brought me a lot of comfort and i'm going to look again into the threads etc.
I was hoping you could help me by answering the following questions:
1. If I do end up going to court and losing (unlikely though you all suggest it may be), and pay the £200 as per @patient_dream suggests, would that also be accompanied with me receiving a CCJ?
2. So I have to do the AoS and then also fill out the form that they gave me? or just one of these things?
3. Once I do the AoS, I then fill out the defence, where does this get sent to? What is the next stage after this?
4. Difficult to answer i'm sure, but in honesty how long would say for a first timer it will take to do the AoS and Defence? Just so I know how much time I need to assign to doing this.

4a. Filing an AoS shouldn't take more than a few minutes - half an hour at most.
4b. It has been suggested that if you use the ready made template then an hour may be enough, but everyone is different.
Please can I ask that before you ask any further questions you first read the second post of the NEWBIES thread - I gave you a link to it earlier - where pretty much every question you can think of is answered.2 -
As above , no paper , NO filling in paperwork , no posting using royal mail either , AOS online on MCOL , then treat MCOL as read only after that , no filling in any other boxes or sections on MCOL , everything is done by email after the AOS is done , unless anything changes1
