  • Sorry, you're right, it's ECP. 

    My wife is going to the pub today (on foot) to try and speak to the landlord and ask for any footage that can shed more light on things. She remains adamant she only turned the car around (as her friend lives literally over the road, but we approach the road from the 'wrong' side to get into her drive properly).

    I've looked at my VC5 and it was changed about two weeks after the charge was sent out - so it seems they have sent the charge out to the address they had on file at the time. 

    I've had a read through the newbies thread now. Seems like complaining to the pub/Ember Inns is the first line of attack, once we've got supporting info, and if not them then POPLA.

    Regarding the address - should I contact ECP and DRP in writing just simply stating their correspondence address is incorrect and needs updating? Or at this stage is no contact with them the best thing to do?

    Send a rectification notice to the DPO of the PPC instructing them to erase the keeper's details and replace them with the new address for service, and to inform all their agents of the same. Make sure you use the word I have highlighted.

    You could tell DRP as well, but they are powerless so it won't matter if you don't. Personally I wouldn't bother because that's ECP's job once you have instructed them as above, but that's entirely up to you. 
    DRP can only send out poor quality bog-paper.

    You won't get a popla code because the time to appeal has expired

    Had it been appealed in the correct time frame then the normal hurdles were available , so you want a cancellation by ember inns

    You need a copy of the NTK PCN from the DPO at ECP to check the times and time on site , because I cannot believe that ECP issued a PCN for less than 5 minutes ! It does not compute

    Turning round according to your story does not take 5 minutes to achieve !

    Mail redirect would have been a good idea too

    Follow the advice by fruitcake about data rectification too

    Have you complained to your MP and posted bad stuff on TripAdviisor and local pub websites?  
    You never know how far you can go until you go too far.
  • Wife went into the pub this afternoon and explained her story and left her details after they agreed to get it rescinded. Let's see.

    I sent an SAR to ECP and also used Fruitcake's advice on the erasing of previous keeper's details, and provided a new correspondence address.

    When they respond I'll alert them to the fact that the pub are rescinding the charge and will follow up with another SAR in the future to check they have nothing on record. I doubt I'll get a confirmation letter stating it's been rescinded?

  • Hello all,

    I've read the Newbies thread and searched for an existing thread which matches my scenario and found this one. So I'm adding a comment here in the hope that I can find advice on what is a similar situation.

    I changed address earlier this year and forgot to update details with the DVLA, so they still have the old address.

    I have been passed on letters from both Euro Car Parks and Debt Recovery Plus chasing payment for a PCN. I've only just got these letters, my fault I know.

    The parking offence is dated July 2022 and it appears the car was parked longer than the limit and more than any grace period. So not sure there would be anything to appeal and I'm after appeal period anyway.

    Any suggestions on what to do?

    Can I ask Euro Car Parks if I can pay the discounted amount as I've only just found out?
    Do I not pay?
    Do I wait it out now as we are beyond the appeal stage and just hope they don't go to court?

    You must respond to ECP and DRPlus (DPO email addresses shown on their Privacy webpages) to tell them to 'erase' the old address and note on their records that the correct postal address for their database is xxxxxx.

    DO NOT assume you don't have to do the above because they've found the new address.

    Do NOT offer money.

    Do ask ECP and DRPLUS to honour the spirit of the new DLUHC Code of Practice that the BPA has told them to implement, and re-issue the PCN at the original rate to the right postal address so that it can be paid or appealed.

    (They won't.  But ask anyway!).

    Meanwhile, complain to the retail park agents of course, as per PLAN A in the NEWBIES thread.  Never too late to deploy PLAN A.

    I'll also make a complaint to the retail park agents and see what response I get.
