Debt Recovery Plus letters sent to previous address

I’m sorry I’m sure you have probably seen similar to this previously but I’m not the smartest when it comes to things like this, so apologies if this has already been covered elsewhere.

We moved address earlier this year, our previous landlady contacted us to say some letters were delivered there, we collected them and there were 3 letters from DRP with a fine and the latest saying that we have lost the right to appeal etc – joy! We didn’t get the original letters from the PPC – presumably the new tenants threw them away and have only kept the most recent ones.

I’ve read the Newbies thread but as I said I am not the best at understanding things and my partner has mental health issues and is so paranoid about this and wants to just pay the fine. I know from reading the newbies thread there is nothing they can do, but as these letters are going to our old address is there any way to update this or stop the letters going to the old address?

And if the PPC ever do try a small claim will they write to the previous address? I’m tempted to return one of the letters to DRP saying no longer at this address, I’m not going to phone them and don’t really want to write with our current address!

Just not sure what to do next, even though this has probably been covered elsewhere and if it has, I apologise again! Thanks for any help in advance

    You'll need to provide the PPC with a forwarding address.  People have moved and then not seen a letter before claim and ended up with a Default CCJ for not engaging (merely because they didn't know). Give the PPC your new or a suitable forwarding address. You don't have to engage with them. A lot of PPCs get loads of companies to chase people at the same time so they could of instructed DCBL, ZZPS, QDR, Gallstones etc so you may not hear anymore from them so you need to report your new address to the source/ 

    But you don't have to actually engage with them or pay an unfair disputed charge.

    Any idea if we will continue to receive letters from DRP to the old address after this, and if so how long will they keep sending them?

    Send a Data rectification notice by email to the DPO at the PPC and attach copies of 2 recent redacted utility bills as proof of I D under the GDPR law to erase your old address and use the newly provided address for service of papers

    The DPO email address is on the privacy page of the PPC website ( which PPC ? )

    Ignore debt collector letters , it's irrelevant if you receive them or not , they are powerless !

    Do not ignore a formal LBC or a court claim pack from the CCBC in Northampton

    It is essential that these 2 arrive at your current address , hence the data rectification notice to the DPO at the PPC

    You contact the Data Protection Officer of PPC via the Privacy section of their website, following the instructions detailed there. You tell them that this is a Data Rectification Notification and ask them to remove your previous address xxxxx, and replace it with your new address yyyyy to where all future correspondence must be addressed. Tell them to notify any of their agents, in particular Debt Recovery Plus, who are handling your data to remove your former address and only use your new one. They are required to do this under GDPR legislation. 

    I’m tempted to return one of the letters to DRP saying no longer at this address
    And play right into their hands!  If anything will encourage DRP to tell the PPC to go ahead with a court claim to a former address to achieve a judgment in default (trashing your credit rating) then that's it - 'no longer at this address'!

    Any idea if we will continue to receive letters from DRP to the old address after this, and if so how long will they keep sending them?
    You can't stop them unless you get the charge cancelled by the PPC or via a landowner instruction, or more likely now by a Judge in a court case.  

    Which PPC?

    Thanks I've had a look for the email address and have found one so will send an email today.

    The PPC is Horizon Parking limited.

    I've looked at photos we took on the day and I don't actually think we were there for the 4 hours but its all done by ANPR, all so annoying!!

    Great thanks, will do this. ASAP, its Horizon Parking. I think I have found the email address. 

    Will find some utility bills and send them over tonight.

    How often do these things go to court?

    How long is a piece of string ?  We asked for the claimant name for a reason , to see if they had form for a court claim , or not

    Nothing is guaranteed , Horizon have 6 years to issue a court claim pack from the CCBC in Northampton

    Whether they will do , or not ?? Is another story. We have no way of knowing so not worth speculating
  • Thanks, when you say Claimant name do you mean Horizon, or the place where the car was parked. I can provide this information if needed?

    Is it worth trying to get the charge cancelled by the PPC when contacting them? we had a lot going on at the time and with the house move, as well as various family issues so we didn't update the V5 log book right away. 
  • Do not deal with PPCs by phone - ALWAYS email or postal letters (with proof of postage receipt). But email is better as there will be an audit trail. I wouldn't put it past certain firms to say they didn't get your change of address details so they can keep schtum and proceed onto a phantom default CCJ against you as its been reported to happen here before. A default CCJ that you don't know about is a bigger payload for them in the long term so I wouldn't put it past them.

    Where was the site? Was it a supermarket? If so you might still be able to get it quashed as I had a Horizons one kyboshed at Asda when speaking to the Customer Services Manager even though it had gone to DRP.
