    I've just been told by my friend that this has been heard by a hanging judge. They have awarded all costs and the full amount claimed to the PPC. It was heard at the court and the PPC's representative attended. The session lasted a full 90 minutes.

    Hopefully the transcripts will arrive soon. This is a disaster and no doubt a miscarriage.

    I'll speak with them more tomorrow. This is bad news and basically the Bevis defense has been shot down plus all the recommended given arguments here. The spurious 'admin' fees all bonified.

    I'm particularly shocked as the strongest argument the signs. It was wholly unclear who the contract was formed with (Bransby Wilson or MB)

    I don't want to come to any conclusions without hearing more but I think this forum needs to put some massive disclaimer. This was nasty.

    So my question here are as follows

    1. Does my friends judgement represent a watershed moment, has a precedent been set?
    2. Have their been any major changes in the law justifying the PPC's claims (the one given above was particularly dubious)
    3. Do county court judges get it wrong frequently and what's the Board's experience with this?
    4. Even with a seemingly tight defence and judgement can the course of conversation and questioning in the Court turn the table so dramantically?
    5. Do people ever challenge these judgements and appeal successfully?
    6. Apart from the expert contributors on this board's assessment, is independent legal advice recommended at this stage?
    7. Any advice further advice for my friend if they want to challenge the judgement (I know this depends on what happened at the Court case but is it a case of sucking it up and capitulating to the PPC's/Judgement)
    8. Are transcripts available / copies of the judgement and if not how are these obtained?


     


    As far as i know here are a few answers:


    1: no, not watershed moment set, no landmark moment just another roll of the county court judge  lottery

    2: No

    3: Yes, ~Judges can get things wrong if you search this forum for "lottery" then thats what you can end up with - there should be an avenue to appeal this although it will invovle hard work and hard evidence to ensure that things are watertight

    4: see #3

    5: not many people appeal as there is more at stake, however its not unheard of - wait for others to comment - and also ensure that your freind follows this up and posts here to avoid any confusion form second hand info

    6: you could try, but you will need someone who understands private parking etc - wait for others on this forum to advise further

    7: see above

    8: yes, but as far as i know they are expensive


    A few other thoughts,

    what happened when a complaint was issued to the landowner?

     was evidence supported by photos submitted?
