Particulars of Claim ... what the Claimant is making their claim about.

  • Thanks, is POFA relevant as the area seems to be subject to bye laws. E.g the car owner gave my wife'  details to VCS but should VCS have asked DVLA for the Owners info?

The DVLA do not know who the owner is, there is no register of owners in the UK only keepers.  If you read your (or any) V5C it states that being registered keeper is NOT proof of ownership.

Yes and VCS did do that. You told us on 4th November that the RK responded to VCS giving them your wife's name as the day to day keeper.

Snipping off the rest of your post as the latter part seems to have sent people down an avenue and missing your question.

The answer is No ... if the land is covered under bylaws then only the driver is liable for the charge, and such charge can only be lawfully pursued via the magistrates courts with a time frame of 6 months (from date of event) in which to bring a case. Keeper liability via POFA does not apply on land covered by bylaws as it is non-relevant land.

That doesn't stop VCS mind - they still try to hoodwink consumers and the courts by bringing civil claims in respects of events on non-relevant land. :)

OK, I've got the link to the latest bye laws :

    https://www.liverpoolairport.com/media/3936/liverpool-john-lennon-airport-byelaws-september-2021.pdf

But they don't mention the area covered. Do you know where I can find a definitive map or is that not necessary?

  • Defence submitted. No response to SAR request. Do I still need to do a WS?

    Yes, of course.

Go back to that list you were following when you filed your Defence.

Item 6 on that list reads...
    6. After filing your Defence, there is more to do.
    Read item 7 onwards.
