JLA 'stopping' charge

  • And is there clear evidence from the photos that you hopefully have got from a SAR, that she stopped on a double red line? 

    Is there evidence that she was even in the roadways that are considered tom the enforcement zone?  @Fruitcake has a case in Bristol Airport where the camera car was reportedly taking images of cars outside the enforcement roadways, on slip roads, at barriers, etc.
    We don't have anything yet from the SAR but did revisit at weekend (in daylight) and my wife is pretty sure that she did stop past the signs but before the roundabout where further signs indicate where to park.

    Guess I cannot start my defence until I receive all their information, so can I apply to CCBC to extend the 28 days?

    No , you should start your defence draft asap , the SAR reply is for later in the process , a court claim is not dependent on the SAR , it's not a part of the process , but we do recommend that it is done at the LBC stage , but in your case it's been done at the court claim stage , so later

    If you were given a deadline date and time , stick to it , 33 days after the issue date , if the AOS was done correctly. KeithP gave you your deadline , 6th December

  • OK, 've started draft using this from Coupon-mad: 'Suggested template defence to adapt for all parking charge cases where they add false admin costs'

    Do I need to reference the case on the JLA Trading estate (that was on a single lane road, not a dual carriageway) or wait to see if VCS refer to this later?

    '28 working days'. What are they on?
    But as it was an 'automated response' I guess that time limit isn't specifically about responding to a Subject Access Request.

    The Data Protection Act 2018 allows them one calendar month. That's all.

    Twenty-eight working days is nearly six weeks.

    If you have received nothing by 5th December, give them until Monday 6th, then email them again stating that they have seven days to respond to the SAR and failure to so will result in you reporting their tardiness to the Information Commissioners Office.

    But as others have said, you really do not need a SAR in order to add a 'facts' para 3 into the template defence.

    If it says you owe money for being in Liverpool and you were in Brisbane ! If it says you are liable when you are not liable , if it says it happened on 11 September 2020 and the vehicle was only ever there on 09 November refute it , if it says you owe rent money yet every bill was paid in full , refute it , etc
