Any more shenanigans from Armtrac and I’ll give it that a go 😁D_P_Dance said:Read CPR27.14(2)(g)0 -
What was the outcome of your appeal ? Did it resolve successfully ? We have the same problem. We are convinced their machine/machines are faulty.0
-
Hi, no the appeal wasn't successful in that the appeals body's policy is just to turn it down out of hand, which I expected, because they have nothing to lose by sending a letter to put more pressure on you to pay up at this stage.
They restated that we didn't comply with t&C's didn't have a valid ticket etc. and my witness statement wasn't a proper witness statement, as it was an email and I'd blanked out the full email address, not signed and I could have just made it up etc.
Unfortunately their tactics worked worked and my partner paid without telling me, after he spoke to his 'legal guy' at work, who advised him it may be better to pay. He said it was his name on the PCN and he didn't want me to spend any more time on it. I was so cross because that's exactly what these sharks rely on and they prey on people who can't afford to pay or don't have the wherewithal to fight it.
That said, I'm sure they wouldn't have taken it to court. The precedent has been set via the Parking Eye V Beavis case, the law has changed or is about to on this, and it contravenes the code of practice, so extremely doubtful that any judge would have found in their favour.
I also think if we'd known that the PCN was concerning a keying 'error' (the PCN was generic and we had chucked the ticket) and we'd been able to assert, in our initial appeal, the correct VRN had been keyed, in our initial appeal, Armtrac probably would have given in at this point, as they did with Loobyloo12345's appeal.
If you're initial appeal is turned down and you want a witness statement to confirm that we were falsely accused of a keying error, to give weight to your case on the basis faulty machine let me know. I'm sure @Loobyloo12345 would be willing to help too. It may also be worth writing to your MP and asking them to take it up with the local one.
Let us know how you get on!3 -
I warrant your partner's legal chap at work knows less about the unregulated parking industry than the regulars on here.
What a shame he paid it. He has been well and truly mugged.I married my cousin. I had to...I don't have a sister.

Perhaps the "legal chap at work" would like to donate some/all of the money paid to the PPC!3

Hi @z@zhonguonurenzhonguonuren said:Hi there ! Is this St Ives again??? If you want me to go and take some photos of signage let me know. Also can someone remind me of the company’s registration number so I can have a look at it on Companies House.By the way, I am very interested in parking tickets on Dynamite/Lelant Quay (parking for Porthkidney Sands). Should any crop up, please DM me.
My dad's recently received a Notice to Keeper for this exact car park (St Ives). If your offer is still open would you mind taking some photos of the signage etc so I can help him with his appeal?
My dad did buy a ticket but paid cash and no longer has the ticket so I can see it being a hard one to defend. We'll write and ask for the regs entered on that day but from reading about Amtrac they don't appear to like playing ball / playing fair so we'll see what comes of it.
Thanks in advance!0 -
